§ 23-20 MARTINSVILLE CODE Sec. 23-20. Wasting water. It shall be unlawful for the owner or occupant of any premises, having thereon a hydrant or other fixture for supplying water, to permit water to run carelessly in a wasteful manner. Service may be discontinued for violation of this section. (Code 1971, § 17-31) Secs. 23-21--23-25. Reserved. DIVISION 2. EXTENSIONS WITHIN CITY Sec. 23-26. Purpose and application of division. There are hereby established by this division regulations governing the conditions and standards under which the city will permit the public water and sewer lines to be extended Within the corporate limits of the city along or over streets, alleys, public rights-of-way or easements, which were dedicated or made a matter of record prior to adoption of the subdivi- sion ordinance (December 17, 1957), in the circuit court clerk's office of the City of Martins- ville or of the County of Henry, Virginia. (Code 1971, App. C, § 1) Sec. 23-27. Definitions. For the purposes of this division, the term "applicant" shall mean a person desiring to extend the public water or sewer lines, or both, in accord with the provisions of this division, and the term "department" shall mean the city public works department. (Code 1971, App. C, § 2) . Sec. 23-28. General procedure. Any person desiring to extend the public water or sewer utility lines within the city shall conform to the following procedure: (1) Suitable information shall be supplied to the department as evidence that each street on which it is proposed an extension be made has been established and made a matter of record prior to December 17, 1957. The department may require the information to include the date and map book or deed book reference wherein the street was dedicated and recorded, if such reference is necessary to establish the claim of dedication or recordation. ~ (2) A plan and profile shall be prepared and submitted to the department of the section of street pertaining to which the request has been made of the extension of the lines. This plan and profile shall indicate the unfinished and proposed finished grade of the street, location of all necessary storm drains, both existing and proposed, and pro- posed elevations of the water or sewer lines. (3) The department director may request of the' applicant a plan and profile of the street beyond the point in which utilities will be extended, if it is deemed: necessary to 1368
