§ 19-23 MARTINSVILLE CODE' <br /> <br />Secs. 19-23--19-32. Reserved. <br /> <br />ARTICLE II. DRIVEWAYS* <br /> <br />DIVISION 1. GENERALLY <br /> <br />Sec. 19-33. Definitions. <br /> <br /> For the purposes of this article, the following terms shall have the meanings ascribed to <br />them in this section: <br /> <br /> Driveway. The term· "driveway," used above, shall include a "private driveway" and a <br />"service driveway," as herein defined. <br /> <br /> Private driveway. The term "private driveway" shall mean any concrete or other type <br />driveway constructed or reconstructed in or upon any street not intended for use or used <br />generally by the public, whether it is in a business zone· or in a residential zone. <br /> <br /> Service driveway. The term "service driveway" :shall mean any concrete or other type <br />driveway constructed or reconstructed in or upon any street and intended for use or used by <br /> <br />(Code 1971, § 15-16[a]) <br /> <br />Sec. 19-34. Reserved. <br /> <br />Sec. 19-35.· Resolution of questions arising from administration and enforcement of ·- article. <br /> <br /> All questions arising. in connection with the administration and enforcement of this <br />article shall be presented first to the director of public Works and then to the city manager. <br />Such questions may then be presented to the board of zoning appeals on appeal from the city <br />manager. From the decision of the board of zoning appeals, recourse shall be had in the courts <br />as provided by law. <br />(Code' 1971, § 15-1611]) <br /> Cross reference--Board of zoning appeals, App. B, § XIII. <br /> <br />Sec. 19-36. Permit. <br /> <br /> It shall be unlawful for any person to construct and maintain any driveway in the -city, <br />without first securing a permit therefor from the director of public works, unless the driveway <br />is constructed by city forces. <br />(Code 1971, § 15-16[b]) <br /> <br />Sec. 19-37. General construction requirements. <br /> <br /> Where curb, gutter and sidewalk exist and a permit· is granted under this article for a <br />driveway opening, all curb, gutter and sidewalk shall be removed the full length· of such <br /> <br /> *Cross reference--Authority of traffic engineer to designate private· driveways as "en- <br />trances" or "exits," § 12-36. <br /> <br />1130 <br /> <br /> <br />
