§ 19-7 MARTINSVILLE CODE <br /> <br /> (b) It shall be unlawful for the operator or driver of any motor vehicle to take delivery of <br />any motor vehicle fuel from a fixed pump or tank in the city at any time when the motor <br />vehicle, or any part thereof, is standing within the lines of any public street of the city. <br />(Code 1971, § 15-14) <br /> <br />Sec. 19-8. Guard raft, fence or wall required for dangerous conditions adjacent to <br /> street or sidewalk. <br /> <br /> (a) It shall be the duty of every owner or person occupying or in control of any property <br />abutting on any sidewalk, street or alley to erect a suitable guard rail, fence or wall between <br />such street, alley or sidewalk and any excavations, holes or other dangerous situations or <br />materials which are allowed to remain or be on such property and adjacent to such street, <br />alley or sidewalk. <br /> <br /> (b) Each day that a violation of this section is allowed to continue after notice from the <br />director of public works or chief of police shall constitute a separate offense. <br />(Code 1971, § 15-22) <br /> <br />Sec. 19-9. Barbed wire fences or other hazardous barriers along or on street or <br /> sidewalk. <br /> <br /> (a) It shall be unlawful for any person to erect or maintain along or on any street or <br />sidewalk of the city any barbed wire fence or other type of fence, fixture or barrier which is <br />hazardousto persons using the street or sidewalk. <br /> <br /> (b) Each day that a violation of this section continues after notification' by the city <br />manager to remove such fence, fixture or barrier shall constitute a separate offense. <br />(Code 1971, § 15-12) <br /> <br />Sec. 19-10. Trees on streets or sidewalks. <br /> <br /> (a) Shade trees may be planted along a sidewalk pursuant to a permit issued by the <br />director of public works and at such points as he shall designate, but no cottonwood, poplars <br />and silver maples shall be planted along any sidewalk within the city. <br /> <br /> (b) No person shall Cut, trim, deface or injure in any manner or remove any tree on the <br />streets, sidewalks or other public property in the city, unless permission in writing is obtained <br />from the director of public works. Upon such permission being granted, the Cutting, trimming <br />or removal shall be done in accordance with such regulations and instructions as may be <br />given by the director of public works. The person obtaining such a permit shall pay to the city <br />the actual cost of the city representative in supervising the cutting, trimming or removal of <br />the tree. <br />(Code 1971, § 15-8) <br /> Cross reference--Damaging street trees generally, § 19-29. <br /> <br />Sec. 19-11.
