STREETS AND SIDEWALKS § 19-7 <br /> <br />Sec. 19-3. Construction of sidewalks, curbs and gutters. <br /> <br /> Sidewalks, curbs and gutters shall be constructed in accordance with such policy as may <br />be established by the city council. <br />(Code 1971, § 15-2) <br /> <br />Sec. 19-4. Raising or lowering grade so as to affect abutting property. <br /> <br /> Whenever. the paving, grading or construction of sidewalks or streets anywhere in the <br />city is ordered by the council, it shall be the duty of the director of public works, if directed by <br />the city manager, when in his opinion such street or sidewalk should be so graded as to raise <br />or lower the same materially with reference to the property of abutting lot owners, to make <br />plans of such improvement, showing accurately in feet and inches the elevation or lowering of <br />the street with reference to such adjacent property. Before proceeding with the work, the <br />director of public works shall obtain from the owners of the property to be affected by such <br />change of grade a written waiver of all damages. If such property owners refuse to sign such <br />waiver, the city manager shall report the situation to the council and receive authority from <br />the council before proceeding with the work. <br />(Code 1971, § 15-3) <br /> Cross reference--Permission from planning commission required for alteration of sur- <br />face of road or right-of-way, § 13-31. <br /> <br />Sec. 19-5. Obstructions and unauthorized use generally. <br /> <br /> It shall be unlawful for any person to obstruct any public street, sidewalk or right~f-way <br />or use the same for any purpose other than that for which it is intended, without first <br />obtaining a permit so to do from the director of public works. <br /> <br />Sec. 19-6. Excavations. <br /> <br /> No person shall cut, remove or break any portion of the paved surface of any street, curb <br />or sidewalk, or do any excavating in any street, sidewalk or alley, without first obtaining a <br />permit from the director of public works. Before such permit is issued, the director of public <br />works shall collect a deposit to cover the cost of repairing and replacing the surface so cut, <br />removed or displaced. Such permit shall ~describe the work to be done, the safety precautions <br />to be taken and the time within which the same is to be completed, as well as the amount to be <br />paid. If any. person shall cut, break or remove any paved surface .of any street, curb or <br />sidewalk or do any excavating in any street, sidewalk, lane or public alley, without having <br />received a permit and having paid the deposit as herein required or complying with the <br />permit as issued, he shall be guilty of violating this section. <br />(Code 1971, § 15-4) <br /> <br />Sec. 19-7. Delivery or receipt of motor vehicle fuel on streets. <br /> <br /> (a) It shah be unlawful for the operator or attendant at any filling station, or any place <br />serving fuel to motor vehicles, to serve or deliver fuel to a motor vehicle from a fixed pump or <br />tank at any time when the motor vehicle or any part thereof is standing within the lines of <br />any public street of the city. <br /> <br />1125 <br /> <br /> <br />
