§ 13-40 MARTINSVILLE CODE <br /> <br />added to the special sale goods. The city shall have the right to revoke a special sale permit <br />upon proof that goods not appearing on the original inventory of special sale goods have been <br />commingled with or added to the special sale goods. <br /> <br /> (d) Duration; additional permits. Each special sale permit shall be valid for a period of no <br />longer than sixty (60) days, and any extension of that time shall constitute a new special sale <br />and shall require an additional permit, inventory and fee. A maximum of one (1) sixty-day <br />permit beyond the initial sixty-day permit may be granted solely for the purpose of liquidating <br />only those goods contained in the initial inventory list and which remain unsold. <br /> <br /> (e) Inclusion of permit number, dates; fez. Any person who advertises such sale shall <br />conspicuously include in the advertisement the permit number assigned for the sale by the <br />city, wherein the sale is to be conducted and the effective dates of the sale as authorized in the <br />permit. The commissioner of the revenue is authorized and delegated the authority to <br />administer this section and is empowered to charge a fee of fifty dollars ($50.00) for the <br />issuance of special sale permits. <br />(Ord. Possession of opened alcoholic beverage container on public property. <br /> <br /> (a) Any person in possession of an opened alcoholic beverage container in any public park, <br />playground, or public street shall be guilty of a class 4 misdemeanor. <br /> <br /> (b) This section shall not prevent any person from possessing an opened alcoholic beverage <br />container in any area approved by the Virginia Alcoholic Beverage Control Board in any public <br />park in an event for which a banquet license or a mixed beverage special events license has <br />been issued, or in approved areas and locations at events for which a coliseum or stadium <br />license has been issued. <br />(Ord. No. 92-13, 8-11-92) <br /> <br />Sec. 13-42. Urinating or defecating in public. <br /> <br /> Any person who shall urinate or defecate in any street, sidewalk, alleyway, parking lot, or <br />other place open to public view, except in an indoor public rest room or in an outdoor fully <br />enclosed public rest room type facility, shall be guilty of a class 3 misdemeanor. <br />(Ord. No. 96-8, 8-27-96) <br /> <br />Sec. 13-43. Place used for illegal drugs a nuisance; knowingly permitting, establish- <br /> ing, keeping or maintaining such is a class 1 misdemeanor. <br /> <br /> Any office, store, shop, restaurant, dance hall, theater, poolroom, clubhouse, storehouse, <br />warehouse, dwelling house, apartment, building of any kind, vehicle, vessel, boat, or aircraft, <br />in this city, which with the knowledge of the owner, lessor, agent of any such lessor, manager, <br />chief executive officer, operator or tenant thereof is frequented by persons under the influence <br />of illegally obtained controlled substances or marijuana, or is used for the illegal possession of, <br />manufacturing, or distributing controlled substances or marijuana, shall be deemed a common <br /> <br />Supp. No. 51 806 <br /> <br /> <br />
