OFFENSES--MISCELLANEOUS 8 13-40 <br /> <br /> (e) Nothing in this section shall be construed to require the cutting of any tree or <br />ornamental shrubbery, unless it is .creating a safety hazard. <br />(Ord. of 8-24-82, 8 8-2; Ord. Barred or locked premises upon which food or drink served. <br /> <br /> It shall be unlawful and a class 1 misdemeanor for any person to operate any club, <br />restaurant, place of amusement, dance hall or Similar establishment open to the public in the <br />city where any beverage (including alcoholic, but not limited thereto) or food is served, <br />dispensed or otherwise made available to the occupants behind barred or locked doors and on <br />premises made.inaccessible for proper health, safety and fire inspections at all times during its <br />operating hours. <br /> Cross reference--Penalty for class 1 misdemeanor, 8 1-11. <br /> <br />Sec. 13-39. Sunday offenses. <br /> <br /> The various work, sales and business activities formerly prohibited on Sunday by section <br />18.2'341 of the 1950 C°de °f:vir~fila, as~a~ended, commonly kn°wfi as the ~SundaY CloSing <br />Law, be, and the same hereby are, allowed in the city. <br />(Ord. No. 86-13, adopted Nov. 7, 1986, did not specifically amend the Code; <br />hence codification herein as 8 13-39 was at the discretion of the editor. <br /> <br />See. 13-40. Going-out-of-business sale permits. <br /> <br /> (a) Permit required. It shall be unlawful for any person to advertise or conduct a sale for the <br />purpose of discontinuing a retail business, or to modify the word "sale" in any advertisement <br />with the words "going-out-of-business" or any other words which tend to insinuate that the <br />retail business is to be discontinued and the merchandise liquidated, unless such person <br />obtains a permit to conduct such sale from the city. A violation of the provisions of this section <br />shall be punishable as a class 1~ misdemeanor. <br /> <br /> (b) Inspections; application for permit. The city shall issue permits to retail merchants for <br />special sales as required upon the application of such merchant and shall inspect the <br />advertisement and conduct of such sale to ensure that it is being advertised and conducted in <br />conformity with the required permit. <br /> <br /> (c) Invento~y required; commingling of other goods prohibited. All applications for special <br />sale permits shall be accompanied by an inventory, including the kind and quantity of all goods <br />which are to be offered for sale during the sale, and only the goods specified in the inventory <br />list may be advertised at a reduced price or sold at a reduced price during the sale period. <br />Goods not included on the inventory of SPecial Sale goods shall not be commingled with or <br /> <br />Supp. No. 51 805 <br /> <br /> <br />
