§ 9-9 MARTINSVILLE CODE <br /> <br />Sec. 9-9. Damaging or injuring fire department vehicles or personnel. <br /> <br /> It shall be unlawful for any person to damage or deface, or attempt or conspire to damage <br />or deface, any fire department emergency vehicle at any time, or to injure, or attempt or <br />conspire to injure any fire department personnel while performing departmental duties. <br />(Ord. of 10-26-82, § 13) <br /> Cross reference--Damaging property generally, § 13-28. <br /> <br />Sec. 9-10. Vehicles following fire apparatus. : <br /> <br /> (a) It shall be unlawful for the operator of any vehicle, other than one on official business, <br />to follow any fire apparatus traveling in response to a fire alarm at any distance closer than <br />five hundred (500) feet to such apparatus or to drive any vehicle within the block or immediate <br />area where fire apparatus has stopped in answer to a fire alarm. <br /> <br /> (b) A violation of this section shall constitute a traffic infraction. <br />(Ord. of 10-26-82, § 11) <br /> Cross references--Penalty for traffic infraction, § 1-11; motor vehicles and traffic, Ch. <br />12~ <br /> State law reference--Similar provisions, Code of Virginia, § 46.1-227. <br /> <br />Sec. 9-11. Driving over unprotected fire' hose. <br /> <br /> (a) No person shall drive or propel any vehicle over any unprotected fire hose of the fire <br />department, when laid down on any street, alley, private drive or any other vehicular road- <br />way, without the consent of the fire chief or other officer in charge of the operation. <br /> <br /> (b) A violation of this section shall constitute a traffic infraction. <br />(Ord. of 10-26-82, § 7) <br /> Cross reference--Penalty for traffic infraction, § 1-11. <br /> State law reference--Similar provisions, Code of Virginia, § 46.1-228. <br /> <br />Sec. 9-12. Operation of authorized emergency vehicles. <br /> <br /> (a) As used in this section, the term "authorized emergency vehicle" shall mean and be <br />restricted to those which are defined and authorized under the laws of the state. <br /> (b) The driver Of an authorized emergency vehicle shall not sound the siren thereon or <br />have the front red lights on or disobey any existing traffic regulation, except when such <br />Vehicle is responding to an emergency call or when responding to, but not upon returning <br />from, a fire. Tactical strategies such as, but not restricted to, "move-ups" d0 not Constitute an <br />emergency call. A violation of this subsection shall Constitute a ~raffc i'nfraCtion.* <br /> <br /> (c) The driver of an authorized emergency vehicle may: <br /> (1) Park or stand irrespective of the provisions of existing traffic regUlations. <br /> <br /> (2) Proceed past a red or stop signal or stop sign, but only after slowing down as may be <br /> necessary for safe operation. <br /> <br />*Cross reference--Penalty for traffic infraction, § 1-11. <br /> <br />552 <br /> <br /> <br />
