ANIMALS AND FOWL § 5-5 <br /> <br />Sec. 5-3. Livestock, poultry or birds running, flying a~ large. <br /> Any person who shall permit any livestock, poultry or bird owned by him or under his <br />control to nm or fly at large or unattended upon any street, alley or sidewalk, in any park, or <br />upon the premises of another in the city shall be guilty of a Class 3 misdemeanor. <br />(Ord. City designated bird sanctuary; prohibited acts with respect to birds or <br /> wild fowl. <br /> The entire area within the city is hereby designated as a bird sanctuary. It shall constitute <br /> a Class I misdemeanor for any person to trap, hunt, shoot or attempt to shoot or molest in any <br /> manner any bird or wild fowl or to rob nests or wild fowl nests, provided, that if any bird or fowl <br /> is found to constitute a nuisance or menace to health or property, in the opinion of the health <br /> department or police department, then such bird or fowl may be destroyed in such a manner <br /> as is deemed advisable, by direction or under the supervision of the chief of police. <br /> (Ord. Burial or cremation of dead animals or fowl. <br /> (a) When the owner of any animal or fowl which has died knows of such death, such owner <br />shall forthwith have its body cremated or buried, and if he fails to do so, any judge of the <br />general district court, after notice to the owner if he can be ascertained shall cause any such <br />dead animal or fowl to be cremated or buried by the city animal control officer or other person <br />designated for such purpose. The animal control officer or other person so designated shall be <br />entitled to recover of the owner of every such animal so cremated or buried the actual cost of <br />the cremation or burial, not to exceed seventy-five dollars ($75.00), and of the owner of every <br />such fowl so cremated or buried the actual cost of the cremation or burial, not to exceed five <br />dollars ($5.00). Any person violating the provisions of this section shall be guilty of a Class 4 <br />misdemeanor. <br /> <br /> (b) When the owner of any animal or fowl which has died is unknown or unascertainable, <br />the city animal control officer or other person designated for such purpose shall cremate or <br />bury such animal or fowl at the expense of the city. <br /> <br /> (c) This section shall not apply to dead dogs, the disposal of which is governed by section <br /> 5-48 of this chapter. <br /> (Ord.
