Thursday, September 23, 1999 <br /> <br />facility while the permanent monopole and related equipment are being constructed. This structure <br />would have a maximum height of 135 feet. Wayne Knox gave staff recommendations and pointed <br />out that a question had risen as to whether a railroad easement or fight-of-way constitutes real <br />property and demands notification as part of the special use public hearing process. Norfolk 'and <br />Southern has a main line adjoining the property. Mr. Fred Martin, owner of the site, stated he <br />owned the railroad spur on his property, and that the railroad had disconnected the switch. The <br />recommendations are as follows: 1) The mature vegetation to the noah and west of the proposed <br />facility remain as a visual barrier; 2) The color of the new monopole will be industrial gray: 3) If <br />lighting is required on the. monopole, by the FAA, the light will be positioned to reflect upward; 4) <br />A landscaping plan around the facility will be submitted for approval by the Planning Commission <br />staff; 5) Any changes to the design of this facility or its conditions will be submitted for approval to <br />the Martinsville Planning Commission; 6) The proposed facility will be 40 feet by 40 feet in size; <br />7) Evidence that the proposed structure will have bond or insurance coverage of at least $1,000,000 <br />to adequately cover any damages that may be caused by the monopole or its radio frequencies; 8) <br />Proper signage shall be installed on the fencing surrotmding the facility to ward off any trespassers; <br />9) The new monopole will allow collocation (4 providers). Member Williams made a motion, <br />seconded by Member Ricky Hall, that if a legal opinion ruling was that the railroad did not need to. <br />be notified, that a recommendation be made to City Council to grant the special use request with the <br />nine recommendations and allow the temporary facility. If the legal opinion ruling was that the <br />railroad did require notification, a public heating would be set for October 12 at 1:00 PM. in <br />Council Chambers. The motion carded unanimously (5-0). Secretary Martin abstained from <br />voting. <br /> <br /> There being no further business, the meeting adjourned 3:00 p.m. <br /> <br /> <br />
