TUESDAY, MARCH 23, 1999 <br /> be denied. Vice-Mayor Teague stated his doubt that any future owner of the mall would bring in a <br /> <br />business that would devalue the property, and Council Member Roop confirmed the property owned by <br />Mr. Gautsch's client was already zoned C-3, as was all the property on that side of Church Street in that <br />area. Discussion then took place concerning the heed to avoid spot zoning, and the fact that only the <br />entire mall could be considered in the rezoning. Mr. Phil BurneRe then spoke, stating that he had made <br />substantial investment in his property at 755 East Church Street, and was very troubled by the proposed <br />rezoning. Council Member Haskell then asked Mr. Burncite if his property had been zoned C-3 when he <br />built his business, and was told that it had been. Vice-Mayor Teague then asked if a C-5 zone might be <br />created to include some of the uses allowed in C-3, but not all, such as tire shops and retreading facilities. <br />Mr. Whitlow stated that in C-3 zoning the highest and best use would play the strongest influence in <br />property use at the mall, and that the City' s comprehensive planning process would further state those <br />best uses. Zvlayor Crabtree stated that he had a problem with objections from a property owner whose <br />property was already zoned C-3, and stated that as good neighbors they should seek to work together on <br />the issue. Vice-Mayor Teague agreed that the zoning of Patrick Hertry Mall should be consistent with that <br />of Liberty Fair Mall, but encouraged the acceleration of the comprehensive planning process to avoid <br />future problems in these areas. The Planning Commission Public Heating was then closed and the <br />Planning Commission members voted unanimously to recommend approval of the rezoning of the <br />property in question to C-3 zoning. The Planning Commission then adjourned their meeting. There were <br />no further speakers under the City Council' s portion of the Public Hearing, and this Hearing was then <br />closed as well. Council then adopted the following Ordinance and approved the rezoning of the Patrick <br />Henry Mall property to C-3 zoning, by the following vote: <br /> <br />Vote: 4-0 <br /> <br />Yeas: (4) Crabtree, Haskell, Roop, Teague. <br /> <br />Nays: (0) None. <br /> <br /> Abstentions: Dallas. <br /> <br /> <br />
