TUESDAY, FEBRUARY 28, 1989 <br /> <br />of the present water service agreement with the Henry County Public Service <br />Authority and that there are only 18 covenants recorded involving City water <br />and/or sewer service, although there are thirty-nine separate agreements, some <br />of which apply to large areas being served outside the City. DiscUssion by <br />members of Council then turned to the requiring by the City of covenants in <br />areas and with City-service customers located outside the corporate limits, <br />such aS the R-9 designated recently by Council for the service area abutting <br />the northeast side of Spruce Street (except for existing structures), as <br />recommended by the Planning Commission (see page 333, et seq., and page 440, et <br />seq., of Minute Book No. 26). In that case, the record notes that Council <br />never took action on the specific request for City water service filed by Mr. <br />Jimmy Ray Ford for his proposed mobile home court'off the north side of <br />relocated Spruce Street and outside of the corporate limits although, as <br />hereinbefore stated, Council designated the area to conform to R-9 <br />requirements, as recommended by the Planning Commission for the reasons that <br />this area immediately abuts R-9 zoned areas within the City, a policy Mr. <br />Dyches indicated that he supports. City Attorney Worthy ruled that, inasmuch <br />as presently mobile home courts are allowed only in R-6 districts and, <br />therefore, Mr. Ford can not qualify for water service in the designated R-9 <br />district, Council's action is tantamount to denying--or actually denies--Mr. <br />Ford's request for water service for the mobile home court he proposes to <br />develop. And, as heretofore pointed out by City Manager Brown, the City's <br />water service agreement with the Henry County PSA permits, at the PSA's option, <br />Mr. Ford to receive water service through a service line to be constructed by <br />the PSA to connect with the City's water line along relocated Spruce Street. <br />Councilman McClain pointed to the Planning Commission's duty and efforts to <br />"protect" citizens whose property abuts or lies near corporate limits from <br /> <br /> <br />
