TUESDAY, JANUARY 24, 1989 <br /> <br />Planning Commission's actions in this matter and its recommending to City <br />Council that the petition be granted, inasmuch as Mr. & Mrs. Metz did not own <br />the property (Lots 24, 25, & 26) when they filed their rezoning petition and/or <br />at the time of the Planning Commission's public hearing. Upon being informed <br />by Mr. Metz that he is committed to purchase the three lots, City Attorney <br />Worthy ruled that the petitioners had "enough standing" to file their petition <br />for rezoning. Mrs. Sebastian, noting that she did not receive the required <br />notice of the Planning Commission's public hearingSbut didlearn of it in time <br />to attend the hearing, was of the opinion that thezC-3 zoning of the three lots <br />will depreciate the values of adjoining properties~ In its recommendation to <br />Council, the Planning Commission reported that its role was not to determine <br />the merits of another restaurant being constructed~and operated in the area <br />but, rather, to determine if the property in question should be rezoned to C-3 <br />Commercial, in which event the three lots can be used for any purpose which <br />conforms to--and satisfies--C-3 requirements. Mayor Oakes then declared this <br />public hearing closed; whereupon motion, duly seconded and unanimously carried, <br />Council accepted the Planning Commission's recommendation and, by the following <br />ordinance, amended the City's Zoning Map to effect the requested rezoning: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular meeting assembled, that the Zoning Map of the <br />City of Martinsville, Virginia, be--and is hereby--amended to the <br />extent that properties identified as Lots Nos~ 24, 25 and 26, <br />situated on the east side of Rahlway Street (see City's Tax Map, <br />Page 12, Section 2) be, and are hereby, rezoned from R-9 <br />Residential to C-3 Commercial. <br /> <br />BE IT FURTHER ORDAINED by said Council that, an emergency <br />existing, this ordinance shall be in force oniand after January <br />25, 1989. <br /> <br />In accordance with duly-advertised public notice, Council conducted a public <br />hearing on a petition filed by The Lester Group, Inc., and Developers <br /> <br /> <br />
