TUESDAY, DECEMBER 13, 1988 <br /> <br />Pursuant, too, to duly-published public notice, Council conducted a public <br />hearing on proposed revisions to the City's Subdivision Ordinance, as recently <br />recommended by the Planning Commission, in which hearing no objections to said <br />proposed revisions were registered by any citizen. As recorded in'the minutes <br />of Council's regular meeting held November 29, 1988, as to the method of <br />approving subdivision plats, for which the Commission now has sole authority <br />and responsibility, the Commission recommended a sharing of this authority and <br />responsibility with the City Administration, depending upon the size of the lot <br />or area to be subdivided. And, as also indicated in said minutes, City <br />Attorney Worthy ruled that State statutes do not permit such sharing of <br />authority and responsibility and, therefore, sole authority and responsibility <br />must rest either with the Commission or with the City Administration, whichever <br />is ordained by Council. The record notes, too, that City Manager Brown <br />advocated (and continues to advocate) such authority being vested in the City' <br />Administration on the premise that time heretofore required (by the Planning <br />Commission) in processing subdivision requests can be significantly reduced and <br />(that) he considers the current Subdivision Ordinance, as well as that proposed <br />by the Planning Commission, to be an impediment to the development of property <br />within the City, particularly to the development of housing. In addition, City <br />Manager Brown maintained that, inasmuch as the ordinance establishes and <br />includes standards, the City administration can administer the ordinance <br />provisions uniformly, that matters pertaining thereto can best be handled by a <br />staff engineer (from whose decisions, if elected, appeals can be direct to the <br />Circuit Court), and that vulnerability exposure arising from (alleged) <br />inconsistent actions by the Planning Commission can be avoided. Mr. Brown then <br />recommended that Council postpone action on any of the proposed Subdivision <br />Ordinance changes until such time as Zoning Ordinance revisions (under study by <br />the Planning Commission) are recommended.
