TUESDAY, DECEMBER 13, 1988 right-of-way's appraised value (as determined by the City's Commissioner of the Revenue), which would be required under recently-established City policy, and, therefore, the portion to be closed and abandoned should be from Graves Street along Douglas Street to the rear lot line of the Hazelwood property, with Mr. Hazelwood indicating that he will pay one-half of the appraised valuation (subsequently determined to be $913.00) for the right-of-way section, although one-half of the right-of-way will, in effect, become the property of his neighbors across Douglas Street, owned by Mr. & Mrs. Samuel D. Lipscomb, Jr. Mr. Brown, further, recommended that the closing and abandonment be limited to the section between the Hazelwood and Lipscomb properties, i.e., from Graves Street along Douglas'Street to the rearlot line of the Hazelwood property; whereupon motion, duly seconded and unanimously carried, Council accepted Mr. Brown's recommendation and, to effect the proposed closing, unanimously adopted the following ordinance: BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this thirteenth day of December, 1988, that the section of unimproved Douglas Street situated between Graves Street and the rear lot line of Lot No. 26 owned by Walter E. and Margaret W. Hazelwood, as shown on Section (Page) 50, subsection 11, of the City's Tax Map, with an extension of said rear lot line intersecting Lot No. 21 owned by Samuel D. Lipscomb, Jr., and Robin W. Lipscomb (also, as shown on said Tax Map Section 50, subsection 9), be--and is hereby declared--vacated and abandoned in favor of the Hazelwoods and Lipscombs, subject to the filing of an appropriate mapwith--and the approval by--the City's Public Works Director and/or the City Engineering Division, showing the area hereby declared vacated and abandoned, which map, when and as approved, shall be duly recorded in the office of the Clerk of Martinsville City Circuit Court; and BE IT FURTHER ORDAINED by said Council that, an emergency existing, this ordinance shall be in force on and after December 14, 1988.
