TUESDAY, DECEMBER 13, 1988 <br /> <br />right-of-way's appraised value (as determined by the City's Commissioner of the <br />Revenue), which would be required under recently-established City policy, and, <br />therefore, the portion to be closed and abandoned should be from Graves Street <br />along Douglas Street to the rear lot line of the Hazelwood property, with Mr. <br />Hazelwood indicating that he will pay one-half of the appraised valuation <br />(subsequently determined to be $913.00) for the right-of-way section, although <br />one-half of the right-of-way will, in effect, become the property of his <br />neighbors across Douglas Street, owned by Mr. & Mrs. Samuel D. Lipscomb, Jr. <br />Mr. Brown, further, recommended that the closing and abandonment be limited to <br />the section between the Hazelwood and Lipscomb properties, i.e., from Graves <br />Street along Douglas'Street to the rearlot line of the Hazelwood property; <br />whereupon motion, duly seconded and unanimously carried, Council accepted Mr. <br />Brown's recommendation and, to effect the proposed closing, unanimously adopted <br />the following ordinance: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular meeting assembled this thirteenth day of <br />December, 1988, that the section of unimproved Douglas Street <br />situated between Graves Street and the rear lot line of Lot No. 26 <br />owned by Walter E. and Margaret W. Hazelwood, as shown on Section <br />(Page) 50, subsection 11, of the City's Tax Map, with an extension <br />of said rear lot line intersecting Lot No. 21 owned by Samuel D. <br />Lipscomb, Jr., and Robin W. Lipscomb (also, as shown on said Tax <br />Map Section 50, subsection 9), be--and is hereby declared--vacated <br />and abandoned in favor of the Hazelwoods and Lipscombs, subject to <br />the filing of an appropriate mapwith--and the approval by--the <br />City's Public Works Director and/or the City Engineering Division, <br />showing the area hereby declared vacated and abandoned, which map, <br />when and as approved, shall be duly recorded in the office of the <br />Clerk of Martinsville City Circuit Court; and <br /> <br />BE IT FURTHER ORDAINED by said Council that, an emergency existing, <br />this ordinance shall be in force on and after December 14, 1988. <br /> <br /> <br />
