TUESDAY, NOVEMBER 29, 1988

In acceptance of a Planning Commission recommendation, Council unanimously
approved a variance from Section VIII, Paragraph C.a. 8(g) of the City's Zoning
Ordinance, as a modification of a Special-Use Permit authorized by Council on
March 10,1987, and issued to HABCO Construction Company for HABCO's
apartment/townhouse project off the end of Wood and Crescent Streets, to allow
all townhouse lots in the project to be of the same size for marketing purposes
and to eliminate the possibility of side-yard spaces therein being used for
individual storage, all being in accordance with Council's understanding that
the intent of the City's Zoning Ordinance requirements will be met, in that the
otherwise-required 20-foot side yard space will be included in--and designated
part of--the total common area of the project. In response to an inquiry, Mr.
W. Allen Adams, of HABCO Construction, informed Council that the project
construction should be underway within two weeks.

Council unanimously accepted for introduction--and placed on first reading--a
proposed ordinance (No. 88-11) which, if adopted, will permit the Director of
Finance to present his monthly financial reports on or before the twenty-second
of each month, rather than (as now required) the tenth of each month.

By a vote of four-to-one (Councilman McClain voting against the following
action because of the proposed elimination of a surcharge provision and because
residents and citizens of Martinsville will have not choice or in-put), Council
accepted for introduction and placement on first reading a proposed ordinance
(No. 88-12), as recommended by the City Administration, designed to eliminate
subsections (3) and (4) of Section 23-44 of the City Code, pertaining to
conditions under which City water and/or sewer services will be provided (by
the City) to users located outside the City's corporate limits.
