TUESDAY, JULY 26, 1988 <br /> <br />from the office of the Virginia Attorney General, persons and activities deemed <br />eligible for such exemption, to whom and/or for which permits are issued by the <br /> <br />City Manager: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular session assembled held on July 26, 1988, that the City's <br />Business, Professional, Occupational License Tax Ordinance, 1983, as <br />amended, be amended so that Section 3 under Article 2 thereof shall <br />read as follows: <br /> <br />3. ITINERANT MERCHANTS AND PEDDLERS <br /> <br />Pursuant to the provisions of Section 58.1-3717E of the 1950 <br />Code of Virginia, as amended, all peddlers, as defined by <br />Section 58.1-3717B of said Code, shall pay an annual license <br />tax of $50.00. However, this section shall not apply to those <br />persons who sell, or offer for sale at retail, goods, wares or <br />merchandise as an authorized part of a public exhibition, fair, <br />festival, or other promotional, recreational or special event <br />held in whole or in part upon City property and authorized by <br />the City in the discretion of the City Manager. The <br />authorization required hereunder shall be a permit obtained <br />from the City Manager who, in exercising his discretion to <br />issue same, shall consider the following factors: <br /> <br />Whether such event is sponsored by a civic <br />organization, or by a charitable or other non-profit <br />organization. <br /> <br />Whether the event is conducted by a local industry or <br />other local business for the benefit and enjoyment of <br />its employees. <br /> <br />Whether the event poses any danger, either actual or <br />potential, to the public health, safety and welfare, <br />including, but not limited to, any special traffic or <br />fire hazard posed thereby, and in making this <br />determination, the City Manager shall consult with the <br />City's police chief and fire chief, and any other <br />person with any special expertise in the field of <br />public safety, be they City employees or otherwise, <br />whose advice the City Manager deems it advisable to <br />seek. <br /> <br /> <br />
