No. 26) in conditionally closing a portion of the alleyway. <br /> <br />Accordingly, Mr. Stone suggested that Council refer the original petition back <br />to the Planning Commission for reconsideration, which original petition did noe <br /> <br />involve the Stockton property; otherwise, inasmuch as there are no immediate <br /> <br />plans for the development of his client's property in that area, his client <br /> <br />would withdraw the petition. After some discussion of this matter, and upon <br /> <br />motion, duly seconded and unanimously carried, Council ordered that Mrs. <br /> <br />Stone's initial petition (which did not involve the Stockton property) be <br /> <br />granted, subject to the conditions made a part of the following ordinance, duly <br /> <br />adopted, which describes the portion of the alleyway to ~e vacated and <br /> <br />abandoned: <br /> <br />BE IT ORDAINED by the~Council of the City of Martinsville, <br />Virginia, in regular session held this twenty-sixth day of July, <br />1988, that the following-described portion of an unimproved alley- <br />way situated parallel to-and between--West Main Street and Fayette <br />Street be and is hereby declared vacated and abandoned, subject to <br />(1) continuationof an electric utility easement within said alley- <br />way space and (2) preparation of a map (from a required survey) of <br />the portion of the alleyway hereby being vacated and abandoned, <br />which map shall be presented to the City Planner and, after his <br />approval, must be filed with the Clerk of Martinsville City Circuit <br />Court for recordation. <br /> <br />Said alleyway portion is that which abuts the rear lot lines of' <br />lots 74, 75, 76, 77, and 78 fronting the south side of Fayette <br />Street and the rear lot lines of lots 34, 35, 36, 37, and 38 <br />fronting the north side of West Main Street, as so identified on <br />Section (Page) 32, subsection F,"'double circle" 2, of the Tax Map <br />of the City of Martinsville, Virginia. <br /> <br />Upon motion, duly seconded and unanimously carried, Council adopted the <br /> <br />following ordinance (No. 88-3), as accepted by Council for introduction at its, <br />July 12th meeting and as revised, which ordinance amends Section 3 of Article 2~ <br />of the City's Business/Professional/Occupational License Tax Ordinance by <br /> <br />exempting from local license taxation thereunder, in accordance with an opinion <br /> <br /> <br />
