TUESDAY, APRIL 12, 1988 <br /> <br />therein as well as payment by petitioner to the City of the sum of $1,136.00 <br />(representing 50% of the appraised value of the area being abandoned, pursuant <br />to policy recently established for rights-of-way of certain minimum area being <br />abandoned), with the understanding that the City will retain ownership of, or <br />easement upon, that portion of land upon which the present sidewalk is located, <br />plus a one-foot strip of land along the edge of said sidewalk: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular meeting assembled this twelfth day of <br />April, 1988, that a portion of unused-and-excess right-of-ways <br />situated on the south ~ide of Market Street, east of College <br />Street in front of property at 10 East Market Street, be and is <br />hereby declared'vacated and abandoned in favor of Martinsville <br />Bulletin, subject to the filing by Martinsville Bulletin of <br />appropriate map or maps with--and the approval by--the City's <br />Engineering Division and the City Planner, showing the area <br />hereby vacated and abandoned, which map or maps, when and as <br />approved, shall be duly recorded in the office of the Clerk of <br />Martinsville City Circuit Court. <br /> <br />BE IT FURTHER ORDAINED by said Council that, an emergency <br />existing, this ordinance shallbe in force on and after April <br />13, 1988. <br /> <br />Upon being informed by Mr. J. Ronnie Minter, Commissioner of the Revenue for <br />the City, that he has requested a legal opinion from the Attorney General of <br />the Commonwealth of Virginia on a proposed ordinance (No. 88-3) which would <br />amend the City's BP&O License Tax Ordinance by exempting merchants and/or <br />peddlers, under certain conditions, from the license tax set forth therein (see <br />Section 3 of Article 2), Council continued this matter for further <br />consideration in expectation of the requested legal opinion. Citizens and/or <br />businessmen speaking to this matter were Mr. Tom Leath (of Townes Furniture) <br />and Mr. H. A. Jessie (of Shumate & Jessie Furniture Company). Meanwhile, <br />Council concurred with Councilman McClain's suggestion that a portion of the <br />proposed ordinance (considered as being superfluous) be deleted, when and if <br />adopted. <br /> <br /> <br />
