TUESDAY, FEB}TUS~2~Y 27, 1990 <br /> <br />In addition to the above, Section IV, B-2 of the Zoning 0rdi- <br />nance states that, <br /> <br />If three (3) or more lots or combinations of lots and <br />portions of lots with continuous frontage in single <br />ownership are of record at the passage or amendment of <br />this ordinance, and if all or part of the lots do not <br />meet the requirements for lot width and area as <br />established by this ordinance the lands involved shall <br />be considered to be an undivided parcel for the purpose <br />of this ordinance. <br /> <br />Therefore, even if with the most liberal interpretation of the <br />status of boundaries of the three tracts of land on which the <br />Mall is situated is accepted, the total land included in these <br />three tracts is an undivided parcel under one ownership and, <br />therefore, the construction of buildings across the old tract <br />lines does not violate the Zoning or Subdivision Ordinance. <br /> <br />Your attention is also called to Section III General Provisions, <br />Subsection B of the Zoning Ordinance, Only one principal build- <br />ing on anF lot; lots to abut public streets, <br /> <br />EverF building hereafter constructed or structurally <br />altered shall be located on a lot of record and in no <br />case shall there be more than one principal building <br />and its customary accessory buildings on a lot of <br />record except on the RP-1, C-2, C-3, M-i, M-2 and M-3 <br />districts. <br /> <br />This means that more than one building can be constructed on the <br />land on which the Mall is situated. Based on'the above, sepa- <br />rate Permits were issued for various buildings within the Mall <br />that are separated by fire. walls and a separate Permit was <br />issued for the construction of the McDonald's building, which is <br />detached from the Mall itself· We anticipate that Permits will <br />be issued for other buildings to be situated on land on the <br />tracts on which the Mall building is situated. These Permits <br />are not in any way related to any maps showing leased lines but <br />are and will be considered as sepaPate buildings on the Mall <br />land. Our concern with respect to all such buildings is in <br />relation to setback from streets, parking, conformity with the <br />building codes, etc. <br /> <br />I would also point out that the Building Code allows the issu- <br />ance of Building Permits to lessees of land as well as land <br />owners, therefore, it was appropriate to issue Building Permits <br />for buildings within the Mall as well as to McDonald's. <br /> <br /> <br />
