272 <br /> <br />TUESDAY, FEBRARY 27, 1990 <br /> <br /> Plans <br />Video. A Permit will probably be issued for this business <br />shortly. Before the first Building Permits were issued, a tho- <br />rough review was made of the building plans to insure conformity <br />with the Statewide Building Code. The site plans were carefully <br />reviewed with respect to drainage, utilities, parking, access <br />from Liberty Street and Commonwealth Boulevard. A large amount <br />of research, review and consultations were held by all concerned <br />to insure that all applicable codes were addressed before issu- <br />ing a Building Permit. Since this land area is not a subdivi- <br />sion and no request was ever made to subdivide this land, there <br />was no reason for the City Administration to consider any of the <br />provisions of the Subdivision Ordinance related to the issuance <br />of Building Permits. The application and enforcement of the <br />Zoning Ordinance, Building and related Codes was the primary <br />concern with respect to the proposed Mall development. Under <br />Section XII Enforcement of the City's Zoning Ordinance, the <br />Building Official is authorized and has the duty of enforcing <br />the provisions of the Zoning Ordinance. Mr. Baker reviewed the <br />Zoning Ordinance with respect to whether the lahd on which the <br />Mall was proposed to be constructed was in the proper zone. <br />was noted that the property was zoned M-1 Industrial and R-6 <br />Residential. It was felt that this property should be rezoned <br />to C-3 Commercial, therefore, following usual and legal pro- <br />cedures (including a review by the Planning Commission) this <br />property was rezoned to C-3 Commercial on December 9, 1987. <br /> <br />have been submitted for the construction of Block Buster <br /> <br />Permits were issued based on the definition of a lot as set <br />forth in the Zoning Ordinance, recognizing that the land in <br />question included three land tracts described by metes and <br />bounds (not by map) as previously described. <br /> <br />The Zoning Ordinance "lot" definition is as follows: <br /> <br />Lot. For zoning purposes as covered by this ordinance, <br />a lot is a parcel of land of at least sufficient size <br />to meet minimum zoning requirements for use, coverage <br />and area and to provide such yards and other open <br />spaces as are herein required. A lot may consist of: <br /> <br />A. A single lot of record <br />B. A portion of a lot of record; or <br />C. A combination of complete lots of record, of <br /> complete lots of records and portions of lots of <br /> records. <br /> <br />As can be readily seen from this definition, the area on which <br />the Mall was'constructed conformed to the definition of a lot <br />under the Zoning Ordinance. Therefore, the fact that the Mall <br />building extends across the old tract lines (not subdivision <br />lines) does not violate the Zoning Ordinance nor Subdivision <br />Ordinance. <br /> <br />3 <br /> <br /> <br />
