TUESDAY, OCTOBER 24, 1989 <br /> <br />reflecting the Council's support of the agency's effort to obtain the aforesaid <br />tax exemption. The adopting vote was four-to-one, with Vice-Mayor Willjams <br /> <br />voting against the adopting motion. The resolution follows: <br /> <br /> WHEREAS, the Adult Day Care Center of Martinsville & Henry County, <br /> Virginia, chartered by the State Corporation Commission on September <br /> 7, 1988, desires to operate a facility in the City of Martinsville; <br /> and <br /> <br />WHEREAS, the Adult Day Care Center desires to present legislation to <br />the Virginia General Assembly requesting exemption from taxation of <br />real estate and other property owned by them; and <br /> <br />WHEREAS, the Council of. the City of Martinsville, Virginia, has duly <br />advertised and conducted a public hearing in accordance with Section <br />30-19.04(B) of the Virginia Code Annotated, 1950, as amended; and <br /> <br />WHEREAS, the City Council has considered all of the requirements set <br />forth by the statute in the above referenced section of the Code and <br />as far as can be determined the Center meets these requirements, as <br />follows: <br /> <br />Adult Day Care has received an exemption from taxation <br />pursuant to Section 501(c) of the Internal Revenue Code of <br />1954; <br /> <br />2. Adult Day Care has no alcoholic beverage license and has no <br /> intention of applying for one; <br /> <br />All Directors and Officers of Adult Day Care serve without <br />any compensation and give their time and effort for the <br />benefit of the community; <br /> <br />No part of the net earnings of Adult Day Care inures to the <br />benefit of any individual and a significant portion of the <br />services provided by the organization is generated by funds <br />received from donations and contributions; <br /> <br />All of the services provided by Adult Day Care will be for <br />the common good of the public in the Martinsville and Henry <br />County area; <br /> <br />No part of the activities of Adult Day Care involve carrying <br />on propaganda or attempting to influence legislation or <br />intervening in any political campaign; <br /> <br />No rule, regulation, policy or practice of Adult Day Care <br />discriminates against any individual on the basis of <br />religious conviction, race, color, sex or national origin; <br />and <br /> <br /> <br />
