TUESDAY, SEPT~IBER 26, 1989 SECTION 2. GRANT OF AUTHORITY. Subject to the provisions, conditions, and restrictions hereinafter set forth, there is hereby granted to Southwestern Virginia Gas Company, grantee,'its successors or assigns, effective on July 1, 1989, and for a period of thirty (30) years thereafter, the non-exclusive right to erect, construct, operate and maintain a gas plant, gas system o'r both, and to import, transport, sell and distribute natural~gas,- or a mixture of natural and manufactured gas within the limits of the city, and for these purposes to establish the necessary facilities and equipment and to lay and maintain gas mains, service pipes and other appurtenances necessary to the sale and distribution of gas in and along the streets of the city and to do all things which are reasonably necessary or cust=Omary in the accomplishment of these objectives. SECTION 3. TERRITORIAL AREA INVOLVED. The area to which the franchise granted by this Ordinance (hereinafter called "this franchise") relates includes future as well as present territorial li!mits of the city. SECTION 4. NATURAL GAS. . l Natural gas dis~ributed.:.-by-~t~he!~.~g~n~ is to be furnished in the natural state, without mixture of"~%t,~;..:~.~,.i.~b.~...:..a~action of any natural element, or adulteration, and at' the']~'t"=~I'he~and pressure hereinafter set forth, at the consumer's meter, subject, however, to the removal of oil, gasoline vapors, helium and other hydrocarbons, provided, however, that such natural gas may be combined with a mixture of propane and air having an equivalent heating value and pressure to natural gas. SECTION 5. OBLIGATION OF GRANTEE TO FURNISH NATURAL GAS. (a) ExCept to the extend'that the grantee shall be prevented from doing so by order or rules and regulations of the Federal Energy Regulatory Commission or the Virginia State Corporation Commission, the grantee will deliver to and distribute for the use of the inhabitants within the city, during the period of this franchise, and providing there is a demand for same, natural gas of the heating value and pressure herein elsewhere defined. (b) In the event the supply of natural gas available, allocable or allocated to the grantee is increased beyond the amount presently allocated to it under the order of the Federal Energy Regulatory Commission or other authorized governmental agency, the grantee shall allocate and distribute to the inhabitants and consumers within the city, each time such available supply is increased, if there is then a demand for more natural gas in the city, a fair ratable share of such increased supply. -: (c) The grantee shall be allowed to mix manufactured gas with natural gas for distribution within the city as such mixture may be advantageous to the operation of the grantee.
