126 <br /> <br />TUESDAY, SEPTEMBER 12, 1989 <br /> <br />Mayor Oakes declared this public hearing closed. Councilman Cole then, as he <br />has on another occasion, raised the question as to why COuncil has the <br />responsibility to set'local taxicab rates. City Attorney Worthy reported, <br />having researched this question, that Council may or may not assume this <br />responsibility, i.e., it is Council's option statutorily. On motion, duly <br />seconded and unanimously carried, Council asked that the City Administration <br />study this "option" and provide Council with some basis, for its consideration, <br />to help Council decide whether it should continue this responsibility (as now <br />set forth in the City Code) or abandon the responsibility by amending the City <br />Code accordingly. Also, upon motion, which was duly seconded, Council adopted <br />Ordinance No. 89-11 to amend City Code Section 22-85 and effect the requested <br />revised rates, as introduced at Council's recent August 22nd meeting. The vote <br />on this motion was three-to-one, with Councilman Cole voting against the <br />motion, not in objection to the rate increase as requested but to emphasize his <br />conviction that Council should not regulate such rates. This ordinance was <br />made effective October 15, 1989, to provide sufficient "lead-time" to enable <br />local cab operators to re-calibrate ~heir fare meters to reflect the new rates. <br />The ordinance follows: <br /> <br /> BE IT ORDAINED by the Council.of the City of Martinsville, <br /> Virginia, in regular session assembled September 12, 1989, after <br /> having conducted a duly advertised public hearing, hereby amends <br /> the City Code, Chapter 22 Vehicles For Hire, Article II Taxicabs <br /> and For-Hire Cars, Division 5 Fares, Section 22-85 Taxicab Rates, <br /> as follows: <br /> <br /> Sec. 22-85. Taxicab Rates. <br /> <br /> (a) No owner or operator of any taxicab operated under a <br /> certificate of public convenience and necessity issued under this <br /> article shall charge for the hire thereof a sum that shall be <br /> greater or lesser than the following: <br /> <br /> (1) For the first one-twelfth of a mile or <br /> fraction thereof $1.15 <br /> <br /> <br />
