Young, on <br />behalf of Martinsville Church of God, for a Special Use Permit under Section <br />VIII, Paragraph C.11., of the City's Zoning Ordinance in order to operate a <br />day care center on property located at 219 Clearview Drive. Mayor McClain <br />noted that the Planning Commission had recommended approval.of this request. <br /> <br />There being no public comment on this matter, the Mayor declared the public <br />hearing closed. Upon motion, duly seconded and by unanimous vote, Council <br />approved this request for a Special Use Permit. <br /> <br />Council conducted a public hearing and considered approval, on first reading, <br />of Ordinance No. 91-19 granting a renewal franchise to Adelphia Cable <br />Communications for a five-year term. Mayor McClain declared the public <br />hearing open. Mr. W. H. Yeaman, 1513 Sam Lions Trail, read a prepared <br />staten,ont .in which he took exception to certain aspects of the Cable <br />Franchise Ordinance and the manner in which the Ordinance was negotiated by <br />a Subcommittee of City Council. Robb Gray, Jr., Vice-President and General <br />Manager of FOX 21 and 27, expressed concern because his stations had been <br />denied the opportunity to be carried on the local cable system and stated <br />· thatthefranchise could require Adelphia to carry all licensed, local, over- <br />the-air-broadcast stations. Acting City Manager Heater and City Attorney <br />Worthy noted that the FCC does not .allow localities to designate what <br />stations will be carried by the cable company that has been granted a <br />franchise to operate in the locality. Mr. Joseph Price, Regional Manager' <br />Supervisor of Adelphia Cable Communications, and Mr. Michael Mick, Local <br />Manager of Adelphia, stated that the City Attorney was correct in that City <br />Council could not dictate programming to the Franchiseeo Charles Roark, 107 <br /> <br /> <br />
