232 <br /> <br />TUESDAY,'SEPTEMBER 10, 1991 <br /> <br />special-funds as proposed; and <br /> <br />Whereas, the imposition of Permit Application Fees exacerbate an <br />already heavy~ unfunded, mandate thrust upon the Counties~ Cities <br />and Towns by the Department of Waste Management to meet their new <br />regulations; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, <br />Virginia, in regular session assembled September 10, 1991, that <br />said Council does hereby strongly urge the 1992 General Assembly to <br />amend the Virginia Waste Management Act, Section 10.1-1402(16), <br />Code of Virginia, to exempt the Counties, Cities and Towns from the <br />burden of Permit Application Fees. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council set a public <br />hearing on a request by Theresa Seay to amend Section V--District Use <br />Regulations of the Zoning Ordinance in order to reduce the side yard setback <br />requirement for child care centers. <br /> <br />On the advice of City Attorney Worthy, Council referred back to the Planning <br /> ? <br /> <br />Commission for the purpose of conducting a public hearing, a request from <br />Michael A. Muse on behalf of Martinsville Home Builders, Inc. for the <br />rezoning of Lot 38, located at 1016 1/2 Fayette Street, from R-6 Residential <br />to C-1A Commercial. The Planning Commission had voted to not hold a public <br />hearing-on this request. Mr. Worthy said that his interpretation of the <br />State statutes indicated that the Planning Commission could not refuse to set <br />a public hearing on such a request. <br /> <br />Council considered approval of an amendment to the 1974 Sewage Treatment <br />Contract between the City and the Henry County Public Service Authority. Mr. <br />Brown noted that the 1974 City/PSA Agreement does not provide for the <br />allocation to the City of capacity in PSA facilities, therefore, an amendment <br />to this Agreement is necessary to assure the City the right to buy capacity <br />allocations in the County's Upper Smith River Treatment Plant, Lower Smith <br />River Treatment Plant, and transmission facilities.
