upon motion, <br /> <br /> duly' seconded-=~a~nd by ~' unanimous <br />following Resolution: <br /> <br />TUESDAY, NOVEMBER 27, 1990 <br />vote, Council. adopted the <br /> <br />WHEREAS, House Bill 923, which increased the maximum penalties for <br />three of the four classes of misdemeanor violations, was passed by <br />the 1990 Session of the Virginia General Assembly and was <br />subsequently signed by the Governor; and <br /> <br />WHEREAS, Martinsville City Council adopted Ordinance 90-9 which <br />increased the maximum penalties for violations of City ordinances <br />for two of the four classes of misdemeanor violations to match <br />those allowable under State law; and <br /> <br />WHEREAS, the Charter of the City of Martinsville in Chapter 1, <br />Section 2, Paragraph 37 establishes a $1,000 limit for violations <br />of City ordinances; and <br /> <br />WHEREAS, this provision of the City Charter prevents the City from <br />increasing the penalties for Class 1 misdemeanors involving <br />violations of City ordinances to the maximum of $2,500 allowable <br />under State law; and <br /> <br />WHEREAS, the Martinsville City Council has conducted a duly- <br />advertised public hearing to consider the proposed amendment to the <br />City· Charter as prescribed by Section 15.1-835 of the CODE OF <br />VIRGINIA; now, therefore, <br /> <br />BE -IT RESOLVED by the Council of the City of Martinsville in <br />regular session assembled November 27, 1990 that it does hereby <br />request its representatives in the Virginia General Assembly to <br />introduce legislation that would amend Chapter 1, Section 2, <br />Paragraph37 of the Charter of the City of Martinsville as follows: <br /> <br />Chap. 1, Sec. 2 <br /> <br />(37)'To make and enforce all ordinances, rules and regulations <br /> necessary or expedient for the purpose of carrying into <br /> effect the powers conferred by this Charter or by any <br /> general law, and to provide and impose suitable penalties <br /> for the violation of such ordinances, rules and <br /> regulations, or any of them, by fine not c]foccding one <br /> thousand dollarD or imprisonment not cxcccding twclvc <br /> months, or both; which shall not exceed the maximum such <br /> penalties allowable under the general laws of this state <br /> for misdemeanors or, in the case of traffic infractions, <br /> the maximumpenalties allowable under the general laws of <br /> this state for such traffic infractions; and the city may <br /> maintain a suit to restrain by injunction the violation <br /> of any ordinance notwithstanding such ordinance may <br /> provide punishment for its violation. The enumeration of <br /> particular powers in this Charter shall not be deemed or <br /> held to be exclusive, but in addition to the powers <br /> enumerated herein or implied thereby, or appropriate to <br /> the exercise thereof, the said city shall have and may <br /> exercise all other powers which are now or may hereafter <br /> <br /> <br />
