TUESDAY, SEPTEMBER 22, 1992 <br />Director of Water Resources, explained that the request was in response <br />to legislation adopted by the 1992 General Assembly which provided for <br />the imposition of fees on waterworks operators to establish a <br />Waterworks Technical Assistance Fund and to allow the State of Virginia <br />to retain primary enforcement responsibility for implementation of the <br />Act. Mr. Dyches stated that emergency regulations had been adopted <br />subsequent to Council's consideration of the 1992-93 Budget which <br />imposed fees for FY 92-93. The City's fee for FY 92-93 will be $1.50 <br />per customer account for 7421 accounts as of June 30, 1992. Council <br />also heard a presentation by Barry T. Dunkley, Engineering Field <br />Director for the Department of Health, who explained the activities <br />which would be funded by the new fee. In response to questions from <br />Council, Mr. Dunkley stated that should the City refuse to voluntarily <br />pay the fees, the State would attempt to recover them through every <br />legal means available. Councilman Oakes stated that he disagreed with <br />imposition of the fees and felt that the State should fund these <br />activities through its General Fund and that, if such fees are imposed, <br />they should be considered at the time which the budget is developed. <br />Mr. Dunkley said that public hearings would be held on the fees to be <br />imposed for the next two fiscal years. Upon motion, duly seconded and <br />by a vote of 3 "yes" and 2 "no" (Councilman Oakes and Mayor McClain), <br />Council approved the supplemental appropriation. Councilman Oakes <br />requested that the City be present at a future public hearing on this <br />matter to voice opposition to the fees. <br /> <br />Council acknowledged a financial report for the month ending August 31, <br />1992. In response to a question by Vice-Mayor Adams, Finance Director <br />Richard Fitts stated that unless a Fund had an investment (such as a <br />Certificate of Deposit), its monies are a part of pooled cash.
