TUESDAY, AUGUST 11, 1992 <br />action against either Environmental Transportation Systems, Inc. or the <br />owners of the old R. P. Thomas trucking terminal. Upon motion, duly <br />seconded and by unanimous vote, Council approved the Ordinance on first <br />reading. <br /> <br />Councilman Williams suggested that Council ask the City Manager to <br />confer with a law firm whose major emphasis is in environmental law to <br />ensure that no possible action by the City has been overlooked. In <br />response to a question by Councilman Oakes, City Attorney Worthy stated <br />that the legal issues surrounding this question were more in the area <br />of municipal law than environmental law, but he had no problem with <br />Council choosing to seek another opinion, and in fact, he would welcome <br />it. Mr. Worthy reviewed several legal issues relating to this question <br />in such areas as zoning, the legal definition of a "nuisance", and the <br />potential for a lawsuit against the City for interference in the <br />business relationship between the owners of R. P. Thomas and <br />Environmental Transportation Systems. After hearing the City <br />Attorney's reasoning, Councilman Williams said that he was satisfied <br />with his review of the issues. Mayor McClain suggested that the <br />members of Sensible Concerns About Toxics (SCAT) seek legal opinions on <br />any other options available to the City. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council adopted, on <br />second reading, Ordinance No. 92-13 as follows: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular session assembled, August 11, 1992, that is does hereby amend <br />Chapter 13--Offenses-Miscellaneous of the City Code byadding Section <br />13-41--Possession of opened alcoholic beverage container on public <br />property, as follows: <br /> <br />Sec. 13-41 Possession of opened alcoholic beverage container on public <br /> property. <br /> <br /> <br />
