184 <br /> <br />TUESDAY, NOVEMBER 9, 1993 <br /> <br />regular meeting scheduled for December 28, 1993, due to the scheduled <br />date falling between the Christmas and New Year's holidays. <br /> <br />Council conducted a discussion regarding the filling of a vacancy on <br />the City Council. A vacancy will be created prior to January 1, 1994, <br />when Councilman Steve Draper assumes the office of City Sheriff to <br />which he was elected during the November 2, 1993 General Election. The <br />members of Council discussed the procedure as outlined in the City <br />Charter with the City Attorney, who advised that the Council has 30 <br />days to fill a vacant seat. In the event a majority of Councilmen <br />cannot agree on a replacement, the Council must petition the Circuit <br />Court Judge to set a Special Election to fill the vacancy. The City <br />Attorney advised that, in the event Council is unable to fill <br />Councilman Draper's seat, the date of the Special Election would <br />coincide with the May 3, 1994 General Election of the City Council. <br />The City Attorney noted that the only qualification for appointment <br />contained in the Charter is that the individual be a registered voter <br />within the City. Several Councilmen suggested that persons interested <br />in being appointed to fill the vacancy submit information pertaining to <br />their candidacy to the City Manager for transmittal to the Council. At <br />this point, Thelma Pinkard suggested that George Cox, former candidate <br />for Council, be considered for appointment. Councilman Draper noted <br />that he intended to make his resignation from Council effective <br />December 31, 1993. <br /> <br />In matters not on the agenda, the following items were discussed: (1) <br />Vice-Mayor Adams reported that he had received a complaint from an out- <br />of-town visitor regarding the practice of UPS and Federal Express <br />trucks parking in the street in order to make deliveries in the <br /> <br /> <br />
