Councilman Williams, reviewing the history of the use <br />of the property in question, made a motion to approve the Ordinance on <br />first reading. This motion was seconded by Councilman Draper. <br />Councilman Oakes stated that he had spent more time on this issue than <br />any other matter in the many years he has served on Council. <br />Councilman Oakes expressed concern about the enabling legislation, <br />raising the issue of its enforceability. Vice-Mayor Adams also <br />expressed concern regarding the enforceability of the Ordinance and <br />made a motion, duly seconded and carried by unanimous vote, that the <br />proposed Ordinance be amended to allow for its termination on July 1, <br />1998, the same day which the enabling legislation is terminated. In <br />response to a question by Councilman Oakes, City Attorney David B. <br />Worthy stated it was the duty of Council, not of individual citizens, <br />to enforce the Ordinance if adopted. By unanimous vote, the Ordinance <br />was approved on first reading, as amended. <br /> <br />Council considered approval, on first reading, of Ordinance No. 93-15 <br />amending Chapter 13--Offenses, Section 13-11--Excessive, Unnecessary, <br />Etc., Noise, Subsection (a)(7) of the City Code. Major David Edwards, <br />Assistant Police Chief, was present to comment on the need for adoption <br />of the Ordinance. Also speaking in favor of the Ordinance, which would <br />expand the enforcement of the Ordinance to 24 hours per day in any <br />district of the City (from the present midnight to 7:00 A.M. period in <br />only residential sections of the City), was Rev. Jimmie Hawkins, 408 <br />Second Street. Upon motion, duly seconded and by unanimous vote, the <br />Ordinance was approved on first reading with a minor amendment for <br />clarification. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council approved the <br /> <br /> <br />
