TUESDAY, AUGUST 24, 1993 <br />not related to the proposal to add Paragraph J. to Section VI of the <br />Ordinance, the more relevant public comments related specifically to <br />this section. The proposal to add Paragraph J. to Section VI would <br />provide that a nonconforming use of land involving the transportation <br />or temporary storage of hazardous waste may be terminated after an <br />amortization period of not more than two years as determined by the <br />City Council, provided the City Council, after referring the matter to <br />the Planning Commission and receipt of their recommendation, has <br />determined that the use poses a clear and present threat to the health <br />and safety of surrounding residential homeowners living immediately <br />adjacent to such nonconforming use. The nonconforming use of concern <br />to those in attendance involved the use of the old R. P. Thomas <br />trucking terminal on Fayette Street by Environmental Transportation <br />Services (ETS) as a way station in the transportation of hazardous <br />waste. <br /> <br />Comments regarding this proposed amendment were as follows: (1) in <br />response to questions from Vice-Mayor Adams, City Attorney David B. <br />Worthy said he interpreted the language in the amendment of <br />"immediately adjacent" to mean contiguous or touching (in other words, <br />sharing a common boundary); Mr. Worthy also noted the language <br />"surrounding residential homeowners" to be restrictive terminology; (2) <br />several persons questioned the procedure by which the Ordinance would <br />be adopted, to which Vice-Mayor Adams explained it would need to be <br />considered at two Council meetings in order to be adopted (on a non- <br />emergency basis); (3) Lafayette Jones, 501 Second Street, questioned <br />the City Attorney on the definition of "immediately adjacent" and also <br />asked when the "two years" begins, to which the City Attorney replied <br />the amortization period would begin from the date on which Council <br /> <br /> <br />
