· <br /> <br />TUESDAY, AUGUST 10, 1993 <br /> <br />regular session assembled August 10, 1993, that it does hereby amend <br />the City Code, Chapter 12--Motor Vehicles and Traffic, as follows: <br /> <br />ARTICLE I. IN GENERAL <br /> <br />Section 12-2. Adoption of state law generally. <br /> <br /> Pursuant to the provisions of section 46.2-1313 and section 1- <br />13.39:2 of the Code of Virginia, the requirements of the laws of this .~. <br />state relating to motor vehicles or other vehicles contained in title <br />46.2 of the Code of Virginia, the violation of which are misdemeanors <br />or traffic infractions, which are in effect on July 1, 1993 and all <br />amendments to such laws adopted by the state subsequent to July 1, <br />1993, except those which, by their very nature, can have no application <br />within the city, are hereby adopted and made a part of this chapter as <br />fully as though set out herein verbatim and are hereby made applicable <br />within the city. Any references made to "the state" or "the <br />Commonwealth" in connection with highways, streets, roads, alleys, or <br />other places of vehicular travel shall be deemed to refer to the city. <br />Any future amendment made to a state statute incorporated by this <br />section shall become effective in the city on the same date as the <br />effective date of the state law amendment. It shall be unlawful for <br />any person within the city to violate or fail, neglect or refuse to <br />comply with any section of the Code of Virginia, or amendments thereto, <br />adopted by this section. The penalty for such violation shall be the <br />same as that provided for a violation of the same state law so adopted. <br /> <br />Section 12-3. Adoption of state law as to driving <br /> while intoxicated. <br /> <br /> Pursuant to the provisions of section 46.2-1313 and section 1- <br />13.39:2 of the Code of Virginia, all of the provisions and requirements <br />of the laws of the state relating to driving or operating a motor <br />vehicle, engine, or train, while intoxicated contained in article 2 of <br />chapter 7 of title 18.2 of the Code of Virginia (18.2-266 et seq.), <br />which are in effect on July 1, 1993 and all amendments to such laws <br />adopted by the state subsequent to July 1, 1993, are hereby adopted and <br />made part of this chapter, as fully as though set out herein verbatim <br />and are hereby made applicable within the city. Any references made to <br />"the state" or "the Commonwealth" in connection with highways, streets, <br />roads, alleys, or other places of vehicular travel shall be deemed to <br />refer to the city.
