In response to a question by Mr. Beard, City Attorney David <br />B. Worthy stated that the required audit must be performed by an <br />independent auditor/accountant or amember of the City Staff. At this <br />point in the meeting, Councilman Teague arrived and participated in the <br />balance of the meeting. I~ response to a question by Mayor Adams, City <br />Manager Earl B. Reynolds, Jr. stated that the proposed audit would be <br />much more comprehensive than the current audit which is performed on <br />operators of bingo and raffle games by the Director of Finance. After <br />much discussion, the motion and second to adopt the Ordinance were <br />withdrawn. Council asked the City Manager to prepare a report <br />describing the extent of the proposed audit so that an appropriate <br />audit fee could be determined. <br /> <br />Council considered adoption, on second reading, of Ordinance 94-11. A <br /> <br />motion and second were made to adopt the Ordinance. Mr. Calvin Beard <br /> <br />stated that the Elks had no objection to the adoption of Ordinance 94- <br /> <br />11. Mr. Reynolds reported that he had received a telephone call from <br /> <br />a member of the Regular Veterans organization, which also operates <br /> <br />bingo games, who objected to the Ordinance's proposed level of gross <br />receipts!.~hich must be used for specific purposes. Upon unanimous <br />vote,'the following Ordinance was adopted: <br /> <br />WHEREAS, the operation of bingo and raffle games are regulated by Title <br />18.2--Crimes and Offenses-Generally, Article 1.1--Bingo and Raffles, of <br />the Code of Virginia; and <br /> <br />WHEREAS, said Code of Virginia mandates and/or allows local <br />jurisdictions to adopt and control certain aspects of the Code; and <br /> <br />WHEREAS;"~Sub-p~ag~aph 5 under Section 18.2-340.3 of the 1950 Code of <br />Virginia, as a~eP~, requires that 'a local governing body shall, by <br />ordt~ance,--req~i~e =~s a =condition of receiving a permit in its <br />3urisdiction to conduct bingo games and raffles that the permittee use <br />a predetermined percentage of its gross receipts from all bingo games <br />or raffles for those lawful, religious, charitable, community or <br /> <br /> <br />
