TUESDAY. APRIL 26, 1994 <br /> <br />WHEREAS, Section 42.1-70 of the 1950 Code of Virginia, as amended, <br />provides that any city may, through its governing body, assess, as part <br />of the cost incident to each civil action filed in its courts a sum not <br />in excess of $4.00 to be used for the acquisition of law books, law <br />periodicals and computer legal research services and equipment for the <br />establishment, use and maintenance of a law library, which will be open <br />for the use of the public at hours convenient to the public; and <br /> <br />WHEREAS, the City of Martinsville, Virginia, presently assesses the sum <br />of 82.00 in each such civil action to be used for the aforesaid <br />purposes, and desires to increase the amount of said assessment to <br />S3.00 in each civil case filed in either the General District Court or <br />the Circuit Court of the City of Martinsville; now, therefore, <br /> <br />BE IT DRDAINED by the Council of the City of Martinsville, Virginia, in <br />regular session assembled on April 26, 1994, that it does hereby amend <br />its City Code, Chapter 1 General Provisions, Section 1-15 Special <br />Assessment for Support of Law Library as Part of Costs in Civil <br />Actions, as follows: <br /> <br />(a) Three dollars ($3.00) shall be assessed, as part of the costs <br />incident to each civil action filed in both the courts of record and <br />the courts not of record in the city, pursuant to section 42.1-70 of <br />the Code of Virginia. Such assessment shall be collected by the clerk <br />of the court in which the action is filed and such collections shall be <br />remitted, at the end of each month, to the city treasurer, to be <br />deposited and held by such treasurer subject to disbursements <br />authorized by the city council or its agent for the acquisition of law <br />books and law periodicals for the establishment, use and maintenance of <br />a law library, which library shall be open for the use of the public, <br />and for such other purposes as are allowed by section 42.1-70 of the <br />Code of Virginia. <br /> <br />(b) The assessment provided for in this section shall be in addition to <br />all other costs prescribed by law, but shall not apply to any action in <br />which the commonwealth or any political subdivision thereof or the <br />federal government is a party and in which the costs are assessed <br />against the commonwealth or any political subdivision thereof or the <br />federal government. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council approved a <br />supplemental appropriation from the FY 93-94 Capital Reserve Fund in <br />the amount of $30,584 to be used to purchase two vehicles for the <br />Sheriff's Office. City Manager Earl B. Reynolds, Jr. stated the <br />vehicles could be purchased at less cost in the current fiscal year <br />than if the purchase were made during FY 94-95. <br /> <br />Upon motion, duly seconded and by unanimous vote, Council approved a <br /> <br /> <br />
