TUESDAY, APRIL 12, 1994 <br /> <br />Upon motion, duly seconded and by unanimous vote, Council set a public <br />hearing on a request from William F. Stone, Jr., Attorney, on behalf of <br />Sallie M. Clark, to rezone Lot 3 on Starling Avenue and Lot 5 on <br />Cleveland Avenue, from R-6 Residential to P-2 Professional. <br /> <br />Council considered adoption of a Resolution requesting the Planning <br />Commission to study and make a recommendation to City Council regarding <br />an amendment to the City's Zoning Ordinance on the regulation of <br />storage of hazardous waste materials. City Attorney David B. Worthy <br />noted the Governor had signed legislation which amended the legislation <br />enacted by the 1993 General Assembly. The legislation signed by the <br />Governor became effective immediately, therefore, it would be <br />appropriate for Council to refer the matter to the Planning Commission. <br />In response to a question from Councilman Teague, Mr. Worthy explained <br />the Ordinance amendment would need to be referred to the Planning <br />Commission for their recommendation after public hearing. Upon receipt <br />of the Planning Commission's recommendation, Council would need to hold <br />a public hearing before enacting the proposed Ordinance amendment. Mr. <br />Worthy further stated that the same procedure would need to be followed <br />to terminate the non-conforming use in question, that of the temporary <br />storage of hazardous waste at the R.P. Thomas trucking terminal located <br />on Fayette Street. Upon motion, duly seconded and by unanimous vote, <br />Council adopted the following Resolution: <br /> <br />WHEREAS, the Virginia General Assembly at its 1994 session amended the <br />special statute enacted in 1993 pertaining to the termination of <br />existing non-conforming uses involving the transportation or temporary <br />storage of any hazardous waste by the governing body of the City of <br />Martinsville, and, <br /> <br />WHEREAS, in order to give effect to such amendment by said General <br />Assembly an amendment to the zoning ordinance of the City of <br />Martinsville, specifically to Paragraph J under Section VI, will be <br />required; <br /> <br /> <br />
