TUESDAY, APRIL 12, 1994 <br /> <br />NOW THEREFORE, BE IT RESOLVED, by the Council of the City of <br />Martinsville, Virginia, in regular session held on April 12, 1994 that <br />this question be referred to the Planning Commission for its <br />recommendation, after public hearing, on the question of whether or not <br />Paragraph J under Section VI of said zoning ordinance be amended to <br />read as follows: <br /> <br /> A non-conforming use of land existing at the time of <br />adoption of this ordinance, or any amendment thereto, may be <br />terminated by the Council of the City of Martinsville after <br />a reasonable period of time where such non-conforming use <br />involves the transportation or temporary storage of any <br />hazardous waste, as defined in Section 10.1-1400 of the 1950 <br />Code of Virginia, as amended, if said Council finds that the <br />transportation or temporary storage of any hazardous waste <br />involved in the non-conforming use poses a clear and present <br />threat to the health and safety of persons living or working <br />adjacent to such non-conforming use <br /> <br /> BE IT FURTHER ORDAINED that an emergency exists, and <br />that this ordinance shall become effective on the date of its <br />enactment. <br /> <br />In matters not on the agenda, the following items were discussed: (1) <br />Councilman Teague referred to the City Manager an article from the <br />Roanoke Times & World News regarding changes in the State laws <br />regarding bingo; and (2) Councilman Teague referred to the City Manager <br />concerns expressed to him by Uptown business owners related to their <br />desire to extend the 20 minute on-street parking limit. <br /> <br />In accordance with the CODE OF VIRGINIA (1950, and as amended) and upon <br />motion, duly seconded and by unanimous recorded vote, Council convened <br />into Executive Session for the purpose of discussing the following <br />matters: (1) appointments to the Dan River Alcohol Safety Action <br />Program Policy Board and Martinsville-Henry County Economic Development <br />Corporation Board, as authorized by Subsection 1; (2) a contractual <br />matter, as authorized by Subsection 7; (3) a contractual matter, as <br />authorized by Subsection 7; (4) a personnel matter under the <br />jurisdiction of the Council, as authorized by Subsection 1; and (5) <br />possible disposition of City-owned property, as authorized by <br /> <br /> <br />
