TUESDAY, FEBRUARY 28, 1995 <br />Council and Henry County Board of Supervisors. Upon motion, duly <br />seconded and by unanimous vote, Council approved the supplemental <br />appropriation to be taken from the General Fund's Industrial <br />Development Reserve. <br /> <br />Council considered a request by the City Council to rezone property <br />owned by R. P. Thomas Trucking Company, from M-1 Industrial to C1-A <br />Intermediate Commercial and R-9 Residential. Reginald Scales, City <br />Planner, Zoning & Housing Manager, noted the rezoning would encompass <br />22 lots on 4.97 acres. Mr. Scales reported the Planning Commission had <br />recommended approval of the request. In response to a question from <br />Vice-Mayor Oakes, Mr. Scales said the current usage of the property as <br />a trucking terminal could continue indefinitely after the property is <br />rezoned unless the property were to not be utilized for that purpose <br />for a two-year period. There being no other comments from the members <br />of Council, Mayor Adams declared the public hearing open. Richard <br />Sayers, attorney with the firm Magee, Foster, Goldstein, & Sayers, the <br />bankruptcy trustee for R.P. Thomas, stated that his firm had not taken <br />a position on the rezoning, but asked that Council delay any action for <br />90 days so his firm could evaluate the matter by hiring an appraiser <br />and a firm to perform a Phase 1 Environmental Review on the property. <br />Mr. Sayers stated that his firm, as trustee, has a duty to protect the <br />creditors through ensuring that no actions are taken which would have <br />the effect of lowering the property value. Lafayette Jones, 501 Second <br />Street, Jimmie Hawkins, 408 Second Street, J. B. Travis, 401 Fifth <br />Street, and Denise Wilson, 832 Smith Road, all spoke in favor of the <br />rezoning. There being no other comments from persons present, Mayor <br />Adams declared the public hearing closed. In response to a question <br />.from Vice-Mayor Oakes, City Attorney David B.
