<br />Council considered adoption, on second reading, of Ordinance No. 96-7
<br />amending Section 13-5--Obstructing Justice, Article I--In General,
<br />Chapter 13--Offenses--Miscellaneous, of the City Code. Commonwealth's
<br />Attorney J. Randolph Smith was present to explain the Ordinance would
<br />parallel the State Code. Upon motion, duly seconded and by unanimous
<br />vote, Council adopted, on second reading, the following Ordinance No.
<br />96-7:

<br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in
<br />regular session assembled August 27, 1996, that it does hereby amend
<br />Section 13-5--Obstructing Justice, Article I--In General, Chapter 13--
<br />Offenses--Miscellaneous, of the City Code as follows:

<br />Sec. 13-5. Obstructing Justice.
<br />
<br /> (a) If any person without just cause knowingly obstructs a judge,
<br />magistrate, justice, juror, attorney for the Commonwealth, witness or
<br />any law-enforcement officer in the performance of his duties as such or
<br />fails or refuses without just cause to cease such obstruction when
<br />requested to do so by such judge, magistrate, justice, juror, attorney
<br />for the Commonwealth, witness, or law-enforcement officer, he shall be
<br />guilty of a Class 4 Class 2 misdemeanor.
<br />
<br /> (b) If any person, by threats, or force, knowingly attempts to
<br />intimidate or impede a judge, magistrate, justice, juror, attorney for
<br />the Commonwealth, witness, or any law-enforcement officer, lawfully
<br />engaged in his duties as such, or to obstruct or impede the
<br />administration of justice in any court, he shall be deemed to be guilty
<br />of a Class 1 misdemeanor.

<br />Upon motion, duly seconded and by unanimous vote, Council adopted, on
<br />second reading, the following Ordinance No. 96-8:

<br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in

<br />the City Code by adding Section 13-42--Urinating or Defecating in
<br />Public to Article I--In General, Chapter 13--Offenses--Miscellaneous,
<br />of the City Code as follows:

<br />Sec. 13-42. Urinating or defecating in public.
<br />
<br />Any person who shall urinate or defecate in any street, sidewalk,
<br />alleyway, parking lot, or other place open to public view, except in an
<br />indoor public rest room or in an outdoor fully enclosed public rest
<br />room type facility, shall be guilty of a Class 3 misdemeanor.
