TUESDAY, JULY 23, 1996 <br />Council, three candidates supported the writing of a letter from the <br /> <br />newly formed Council which would ask E.T.S. to relocate. <br />Member Haskell said she would consider signing such a letter. <br />Member Dallas also stated he would support such a letter. <br /> <br />Council <br />Council <br /> <br />In response to a question from Council Member Crabtree, City Attorney <br />David B. Worthy stated that in response to Council's rezoning of the <br />property, the bankruptcy trustee for the R.P. Thomas property had filed <br />suit against the City. Mr. Worthy said writing a letter to E.T.S. <br />could be construed as interfering with the contractual relationship <br />between E.T.S. and the trustee, thereby providing grounds for further <br />litigation. Mr. Worthy stated the only method available to Council to <br />remove E.T.S. from the property would be to acquire it by condemnation. <br /> <br />After further discussion among members of Council and the public, City <br />Manager Earl B. Reynolds, Jr. stated that he would take the following <br />actions in response to the concerns expressed: (1) he would re-review <br />the storm drainage situation cited by Ms. Brooks; (2) he would follow- <br />up on the issue of the removal of the barrels on the R.P. Thomas <br /> <br />property; <br />determine <br />exist. <br /> <br />and (3) he would have City Staff inspect the property to <br />if any violations of the Property Maintenance Ordinance <br /> <br />Upon motion, duly seconded and by unanimous vote, Council adopted the <br />following Resolution: <br /> <br />WHEREAS, the polling place of Voting Precinct No. 2 .in the City of <br />Martinsville, Virginia, is located in the Library of Martinsville <br />Middle School (formerly Martinsville Junior High School) on Cleveland <br />Avenue, in the City of Martinsville, Virginia, and, <br /> <br />WHEREAS, the Martinsville Middle School is currently being renovated <br />and expanded, resulting in the need to relocate the polling place for <br /> <br /> <br />
