THURSDAY, OCTOBER 12, 1995 <br />Association to close and abandon an alley located between 215 and 225 <br />Starling Avenue. Bill Krause, Executive Director of Piedmont Arts, <br />stated the request was being made in order to provide for a future <br />expansion of the Piedmont Arts Association facility. There being no <br />comments from any other persons present, Council declared the public <br />hearing closed. Upon motion, duly seconded and by unanimous vote, the <br />following Ordinance was adopted: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular session assembled this twelfth day of <br />October, 1995, that in order to assure compliance with <br />Virginia Code Section 15.1-491 (g), it is stated that the <br />public purpose for which this Resolution is initiated is to <br />fulfill the requirements of public necessity, convenience, <br />general welfare and good zoning practice, that the alleyway <br />space, as described below, be--and is hereby declared-- <br />vacated and abandoned in favor of Piedmont Arts Association <br />and other adjacent property owners, subject to payment to the <br />City of one-half of the assessed valuation of the property <br />and the filing of an appropriate map with--and the approval <br />by--the City's Public Works Director and/or the City's <br />Planning, Zoning and Housing Manager, showing the areas <br />hereby vacated and abandoned, which map, when and as <br />approved, shall be duly recorded in the office of the Clerk <br />of the Martinsville City Circuit Court: <br /> <br />A 20-foot wide and approximately 250 foot long <br />alleyway space running in a southward direction <br />and extending from Starling Avenue to an <br />intersecting alley of Minor Street, as shown on <br />the City's Tax Map 43-2-C, containing <br />approximately 3,750 square feet of land. <br /> <br />BE IT FURTHER ORDAINED by said Council that, an emergency <br />existing, this ordinance shall be in force immediately upon <br />adoption. <br /> <br />Councilman Teague suggested that it would be appropriate to reserve the <br />funds to be paid by Piedmont Arts ($2,825 being one-half of the <br />assessed valuation) for a future donation to the Piedmont Arts Building <br />Fund. Upon motion, duly seconded and by a vote of 4 "yes" and 1 "no" <br />(Mayor Adams), Council approved appropriating $2,825 to the Piedmont <br />Arts Building Fund, to be paid subsequent to receiving the funds from <br />Piedmont Arts. <br /> <br /> <br />
