MONDAY, SEPTEMBER 11, 1995 <br />period which begins at the finish of the public input process, the <br />franchise authority shall either renew the franchise or issue a <br />preliminary assessment that it should not be renewed; (4) if the <br />franchise authority issues an assessment and an intent not to renew the <br />franchise, an administrative proceeding may occur; (5) at the <br />completion of the administrative proceeding, the franchise authority <br />shall issue a written decision to grant or deny franchise renewal; (6) <br />a cable operator whose renewal proposal has been denied may appeal <br />their case in court; and (7) provisions exist for an informal procedure <br />for franchise renewal. <br /> <br />Mr. Cashwell also summarized current City of Martinsville cable <br />television franchise conditions, with the following being noted: (1) <br />the current franchise agreement will expire on December 31, 1996; (2) <br />the existing service area of the franchise includes the entire City; <br />and (3) the cable operator is required to pay the City an amount equal <br />to five percent of gross revenues derived from the operation of the <br />system. <br /> <br />Mr. Lawler reviewed current Henry County cable television franchise <br />conditions as follows: (1) the County's franchise expires ~anuary 24, <br />1997; (2) the service area is described on maps provided by Adelphia; <br />and (3) the cable company pays the County 3% of its annual gross <br />revenue plus the cost of programming as a franchise fee. Mr. Lawler <br />reviewed issues regarding available technology and other cable-related <br />issues as follows: (1) emergency alerting capabilities for the 911 <br />Center; (2) standby power capability at the headend of the system; (3) <br />improved picture quality of the video linkage from the City Police <br />Department and Jail to the 911 Center; (4) cable service in all public <br /> <br /> <br />
