TUESDAY, OCTOBER 13, 1998 <br />development in similar nearby areas, and that Mr. Maxtin just wanted to be treated fairly. Vice-Mayor <br /> <br />Teague asked if all the adjacent property owners had been contacted, was told that they had been and that <br />there had been no opposition expressed to the rezoning. There were no other speakers, and the hearing <br />was closed. Upon motion by Council Member Dallas and second by Council Member Roop, and upon <br />unanimous vote, all members voting (5-Ayes--Crabtree, Teague, Dallas, HaskeI1 and Roop; 0-Nayes), the <br />rezoning was approved. <br /> <br /> Council next considered the need to conduct a public hearing on a request from Elbert E. and <br />Christine J. Stone to rezone property located at 801 Starling Avenue, from R-6 Residential to P-2 <br />Professional. Mr. Knox again presented the facts regarding the request, stating that the location was <br />currently a single family residence, zoned R-6, but that the Stones wished to establish a business office at <br />the location. He noted that the owner had pledged to maintain the landscaping at the location, and that an <br />adjacent land owner had stated that they had no objections to the rezoning if the landscaping was <br />maintained. Council Member Haskell asked if the maintenance of the landscaping could be required as a <br />condition of the rezoning, and was told that although this could be requested of the land owner it probably <br />would not be appropriate to require this, as prior rezonings did not include such considerations. Mayor <br />Crabtree noted the importance of not making the rules of such rezonings overly restrictive, so as not to <br />inhibit further redevelopment activity. City Attorney David Worthy stated that it would not be legal to <br />make landscaping a condition ofrezoning at this time, and that it would be more appropriate to look at <br />revision of the zoning ordinance at some future date. Council Member Haskell stated that she would like <br />to address this in a future zoning ordinance modification. The Public Hearing on the rezoning issue was <br />then opened, and there were no speakers. Mayor Crabtree closed the Public Hearing. Following motion <br />by Council Member Roop and second by Vice-Mayor Teague, and upon unanimous vote, all members <br />voting (5-Ayes--Crabtree, Teague, Dallas, Haskell and Roop; 0-Nayes) the rezoning was approved. <br /> <br /> <br />
