~52

TUESDAY

APRIL 12, 1955

plans for oonstruction of a building at the southwest corner of Church and Bridge

streets, as filed with the City's Inspection Division and to which the request

applied, be amerrled and signed by Mr. Ford to the effect that an exception to

Building Code Section 2203.1 would not be made.

In connection with Mr. S. H. Baldwin's request to close and abandon a portion of

Smi th-Rucker Road, as referred by Council to the Planning Corrnnission on March 22,

1955, the Planning Cor,1TIlission submitted the follovring recom:racndations, which

Council accepted, Council instructing the petitioner to take the necessary legal

steps and report back to Council for final action:

Honorable 1uyor and City Council
Ci ty of Martinsville, Vil~ginia

Gentlemen:

The Planning Com~ission of the City of Martinsville, at its meeting March 23,
1955, considered a request referred to them by City Council from IvJr. S. H.
Baldwin, asking that a section of Smith-Rucker Road, as yet un-opened, be
closed and abandoned for public use. After due consicieration of this request,
the Planning Cormnission voted unanimously to malce the following recommendation
to the City Council:

That the request as presented by 1tr. S. H. Bal~{in be granted vdth the following
stipulations :

That lJJr. S. H. Baldwin dedicate a lO-foot strip of land lying along the present
30-foot right-oi-way of Smith-Rucker Road for the entire length of his
property, to be used for widening purposes: Also, that he ded~ cate for public
use an adequate pDrtion of his property at the corner of Smith-Rucker Road and
Beaver Street to provide adequate turning radius for vehicles turning to the
right, entering Smith-Eucker Road from Beaver Street.

The Planning Commission, in considering this reque.st, noted the follOl'ring facts:

(1) That the angle of approach of the un-opened portion of Smith-Rucker Road to
the opened portion of Smith-R.ucker Road is not in conformity with good
planning.

(2) That the proximity of its approach to Beaver street and the intersection of
Beaver Street and Sni..th-Rucker Hoad is unde:::;:i.rable because of the fact that
it does not allow for the proper development of properties along Smith-
Rucker Eoad.

The Planning Commission re3pectfully submits the above recommendation for
Council's furu1er consider~tion.

Irving R. FcGhee, Secretary
Lfartimwille Planning COlllf.1ission
