<br />3~ <br /> <br />TUES DAY <br /> <br />JANUARY II, 1955 <br /> <br />",- <br /> <br />taken out of operation for test and repairs, if rel~irs are necessary, or for other <br />failure of this pipe line to satisfactorily deliver water, we assume the <br />responsibility for reimbursing the City of Martinsvi11e at the rate of $30.00 per <br />day as payment for the cost of operating the Beaver Creek Pumping Station to suppJy <br />water to the City of Martinsvil1e from that emergency source instead of from the <br />Beaver Creek Dam by gravity and/or siphonage for which purpose it was constructed <br />and for which purpose the said pipe line was installed. <br /> <br />,- <br /> <br />It is recognized herein that the Cit,v is in no way accepting or implying the <br />acceptan::e of this pipe line by permitting us to test this line as outlined above <br />by initiation of the use of this line as a conduit for c orIVeying water to the <br />City water filter plant. 1Nhen the line has been satisfactorily tested and <br />accepted in accordance with the provis ions of the specifications by your <br />Consulting Engineers and in the presence of representatives of the parties <br />mentioned above who are to witness the test, that the pipe line will then be <br />subject to acceptance and from such date of acceptance our bond in 100 percent of <br />the contract will remain in force for a period of nvelve months as provided in the <br />original contract. <br /> <br />It is further understood that the City may cut off this line in order to deliver <br />water from its Fiillergency Beaver Creek Pumping Station in the event of unsatisfactory <br />operation of the sec lJion of line covered by our contract. <br /> <br />~~~ <br />0" <br />rx <br />i <br /> <br />Until such date as final acceptance has been made by your Consulting Engineers as <br />described above, we agree that we are not to receive the retained percentage which <br />is the balance due on our contract, pumping costs as mentioned above to be <br />de due table from funds due and payable to us. <br /> <br />Ver;l truly yours, <br /> <br />M.
