<br />8 <br /> <br />FRIDAY <br /> <br />DECEMBER 17, 1954 <br /> <br />Paragraph 7. <br />It is the intention that all questions arising in connection with the <br />administration and enforcement of this said Section 17 of Chapter I of <br />Title V, "streets and Sidewalks", of the Street Code of the City of <br />Martinsville, shall be presented first to the City Manager of <br />Martinsville, or his designated agent as the case may be, and that such <br />questions as arise out of the administration am. enforceITBnt of this <br />Section of said Ordinance shall be presented to the. Board of Zoning <br />Appeals only on appeal from the City Manager or his designated agent, and <br />that from the decision of the Board of Zoning Appeals recourse shall be <br />had in the Courts as provided by law. It is further the intention of <br />this Section of this Ordinance that the duties of the City Council in <br />connection with the Ordinance shall rot include the hearing and passing <br />upon disputed questions that may arise in connection with the administration <br />and En for cement thereof, but that the procedure for determining such <br />questions shall be as hereinbefore set out in this Section; and that the <br />duties of the City Council in connection ,rlth this Section of this <br />Ordinance shall be only the duty of considering and passing upon any <br />proposed arrendnent or repeal of the OrdinanCe as provided by law. <br />Paragraph 8. <br />Arry person, firm or corporation who hereafter constructs arry such driveway <br />without having first secured a permit to do so, or who shall fail or <br />refuse to abide by or confonn to the requirements herein, shall be fired <br />not less than $2.50, nor more than $200.00 for each offense, and. each day <br />such use or construction continues shall constitute a separate offense. <br /> <br />BE IT ORDAINED by the Council of the City of Ma.rtimville, Virginia, that <br />Section 9 of Chapter I of Zoning Ordinances of Title I--Planning and Zoning <br />Code be aITBnded to read as follows: <br /> <br />Gasoline or oil filling stations provided that there are no pumps or <br />pump islands within fifteen (15) feet of the street property line adjacent <br />to the sidewalk area. <br /> <br />Continuing its consideration of Mr. J. S. Harris t request of November 23rd for <br /> <br />permission to extend a two-inch galvanized water main from Marshall Street to Harris <br /> <br />Street, Council received requested additional information on said request from the <br /> <br />Water-Street Division which set forth reasons far denying Mr. Harris 1 request as <br /> <br />well as the procedure which Mr. Harris might follow in order to obtain water service <br /> <br />for Harris Street. Council concurred in the Water-Street Division's report and, <br /> <br />thus, denied Mr. Harris 1 request but left the way open by which he might obtain the <br /> <br />water servic e by constructing at his expense a six-inch water main northward along <br /> <br />u.
