<br />L50 <br /> <br />TUES DAY <br /> <br />SEPTEMBER 8, 1953 <br /> <br />Whereas, an emergency exists in the City of Martinsville, Virginia in that <br />instances have been reported in other cities of death due to suffocation of <br />children in abandoned, unattended ice boxes, refrigerators and other containers <br />having air-tight doors which when closed cannot be opened from the inside; and <br /> <br />Whereas, these abandoned, unattended or discarded ice boxes, refrigerators and <br />other containers are a constant menace to the health, welfare and safety of <br />children in said City of Martinsville; <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Martins vi lIe , <br />Virginia, in regular meeting assembled this eighth day of September, 1953, <br />as follows: <br /> <br />It shall be unlawful for aQY person, firm or corporation to leave outside of <br />aQY building or dwelling in the City of Martinsville, in a place accessible to <br />children, aQY abandoned, unattended or discarded ice box, refrigerator or any <br />other container of aQY kind which has an air-tight door, or lock which may not <br />be released for opening from the inside of said ice box, refrigerator or <br />container. <br /> <br />It shall be unlawful for any person, firm or corporation to leave outside of <br />aI\Y building or dwelling in the City of Mar tirnvi lle , in a place accessible <br />to children, arry abandoned, unattended or discarded ice box, refrigerator or <br />aI\Y other container of any kind which has an air-tight snap-lock or other <br />device thereon without first removing the said snap-lock or doors from said <br />ice box, refrigerator or container. <br /> <br />AI\Y person, firm or corporation violating any of the provJ..SJ.ons of this <br />ordinance shall be deemed guilty of a misdemeanor or upon conviction thereof <br />shall be fined not less than ten ($10.00) dollars nor more than fifty ($50.00) <br />dollars. Each day such violation is committed or permitted to continue shall <br />constitute a separate offense and shall be punishable as such hereunder. <br /> <br />An emergency existing, this ordinance shall become effective from the date of <br />its passage. <br /> <br />Pursuant to duly-advertised notice, Council next conducted a Public Hearing on the <br /> <br />City Planning Commission's recommendation of August 11, 1953 that property on both <br /> <br />sides of River Hill Road from the Dye Plant Road intersection South to the City's <br /> <br />corporate limits be rezoned to "B-1 Business'" for a depth of two hundred feet. <br /> <br />Council heard from Mr. W. R. Broaddus, III, and Mr. John Epperly, counsel for the <br /> <br />original petitioners (Mr. and Mrs. Orrin F. Nunn and Mr. H. Claybrook Lester), <br /> <br />who asked that Martinsville Coca-Cola Bottling Company be included as a petitioner, <br /> <br />and who suggested that if the Council did not rezone all of the area recommended by <br /> <br />the Planning Commission that, at least, it rezone the property mentioned in the <br />
