<br />ORDER OF COUNCIL OF CITY OF MARTINSVILLE, VIRGINIA:

<br />Tnis day came Trustees for the Chatham Heights Baptist Church and having
<br />petitioned the Council in the manner and form required by the Code of Virginia in
<br />Sections 15-766 and Sections 33-156 et seq., and having given notice as required
<br />by law of its intention to petition, and having petitioned, for the abandonment of
<br />certain street or streets lyinG in the City of Martinsville, Virginia, running from
<br />Route #57 in a Northerly direction passing between Lots #5 and #6 as shown on a map
<br />of the property designated as Chatham Heights, prepared by Moore and Trent, Surveyors,
<br />September, 1938, of record in the Clerk's Office of the Circuit Court of Henry County
<br />in Map Book 2, page 34, said road also pas~;ing on either side of the Church property
<br />as shown on said map, after having forked into two thirty-foot streets; and the
<br />Council having duly appo:Lnted viewers as required by law and the said viewers havj_ng
<br />returned a report that no inconvenience will result from closing the said street as
<br />aforesaid, now, therefore, the above described street, being the fifty-foot street
<br />passing between Lots #5 and #6 and the thirty-foot streets passing between Lots #5
<br />and #6 and the Church property designated on the map of Chatham Heights above menti-
<br />oned, be and they are hereby discontinued, closed and abandoned as public streets
<br />from this day f oT'"lvard.

<br />It is understood in the promulgation of this order that the Chatham Heights
<br />Baptist Church, by its Trustees duly appointed, and in the manner and form provided
<br />by law, shall deed unto the Ci t.Y of Martinsville the two streets which are shown
<br />on a map prepared by W. I. McGhee, C.P.E., dated the 6th day of Th;cember, 1952, and
<br />filed in this matter before the Council of the City of Martinsville, Virginia, as
<br />a part of the petition of the Trustees of the Congregation of Chatham Heights
<br />Baptist Church, and it is fur~~er directed and ordered that this order shall not
<br />become effective until such deed executed by the lawfully constituted Trustees of
<br />said Chatham Heights Baptist Church, shall have delivered unto the City of
<br />Martinsville, Virginia, a deed of special warranty to said streets, proposed
<br />to be opened and shown on said survey as new streets.

<br />It is further directed and ordered that the Manager of the City of Martinsville
<br />be and he is hereby authorized and directed to deliver unto the Congregation of the
<br />Chatham Heights Baptist Church acting through its 'rrustees, a quitclaim deed to
<br />those streets which are vacated by this order.
<br />
<br />And it is ordered and directed that the Clerk of the Circuit Court of the City
<br />of Martinsville, Virginia, do record at the expense of the Chatham Heights Baptist
<br />Church a map showing, plainly marked, the portions of the streets to be vacated
<br />and the date of th is or der .

<br />Wherefore, the Council of the City of Martinsville, Virginia, has caused its
<br />name to be signed hereto by Hieves S. Hodnett, its Mayor, this 27th day of
<br />January, 1953.
