CONKLIN, et als vs. ORDER CITY OF MARTINSVILLE, et als c,....- This matter came on to be further heard this 11 th day of l1arch, 1959, upon the papers formerly read, and upon the pre trial order heretofore entered on February 13, 1959, upon the view of the area proposed to be annexed, upon the evidence presented in open court, and upon argument of counsel; and the court having considered the best interest of said county and city, the best interests, services to be rendered, and needs of the area proposed to be annexed, and the best interests of the remaining portion of the county, Darn UNANll-10USLY ADJUDGE, ORDER AND DECREE: (see opinion of court filed herein). 1 . 'l'he area sought to be annexed is urban in characted and should be under city government; M:c~~ I.'.".G I~~ ~~r! Hi 2. There is a definite and positive community of interest between the area sought to be annexed and the City of Martinsville; 3. That the area in question is a compact body of land and adaptable to city improvements; 4. That the city will need the area proposed to be annexed in the reasonably near future for its development; 5. That the best interests of Henry County, the City of Martinsville, the services to be rendered and the needs of the area proposed to be annexed will be served ~ annexing the area in question to the City of Martinsville; 6. That under the law, the determining factor is not whether the residents of the area in question want city government but whether the area itself needs city government; 7. That annexation is necessary and expedient and that after annexation the area of Henry County will be in excess of sixty square miles. ME'{Eq AND BOUNm The area to be annexed is described as follows, to wit: - BEGINNING at a point which marks the intersection of the existing corporate lL~e with the southern right of way line of the Old Danville Road, (Old Route #58), said point being designated ~ coordinates N-52, 262.25, E-53, 110.36, as shown on a map entitled City of Martinsville, Department of Public Works, dated 1957 and prepared by City of Martinsville Engineering Department, said poLl1t also being 12.42 feet North east of the Southeast corner of Lot #10, ----~ T .
