R esubdivision <br /> <br />Wherein a subdivider or property owner desires to resubdivide a subdivision of <br />record it shall be neces sary that the subdivider and the resubdivision meet the re- <br />quirements of this ordinance except as may be hereinafter provided. Resubdivis ion <br />shall be deemed to include the relocation of one or more property or street lines <br />within a subdivision of record. <br /> <br />1. Wherein proposal is made for resubdivision of property from standards below <br />the requirements of this ordinance to standards equal to or greater than the <br />requirements of this ordinance, the Commission shall endeavor to secure <br />right-of-way width of streets commensurate with the requirements of this <br />ordinance. Failure to secure adequate street right-of-way shall not in itself. <br />however, prevent approval of the resubdivision. The Commission shall en- <br />courage revisions within the design of existing subdivisione wherein such <br />revision would be to the betterment of the design of the existing subdivision <br />although compliance with all of the requirements of this ordinance are not met <br />in the redesign. <br /> <br />B. Improvements on Streets of Record <br /> <br />The requirements of improvements as set forth in Sec. VII of this ordinance shall <br />not be applicable to streets within or adjacent to a proposed subdivision or re- <br />subdivision wherein such streets were dedicated and recorded in the office of the <br />Clerk of the Circuit Court of the City prior to the enacting date of this ordinance, <br />which streets are termed existing streets. Utilities and improvements on such <br />streets, or portions thereof, shall be in accordance with adopted City Council <br />policy on utility extension and street improvements. This shall not relieve the <br />requirement of compliance with Sec. VII on streets established or proposed after <br />said date, although such streets may connect with or be extension of the existing <br />streets, nor shall it relieve compliance with the remainder of the sections of this <br />ordinance in the design, etc., of lots or subdivision of property adjoining the <br />existing streets. <br /> <br />SECTION IX - SUITABILITY OF LAND <br /> <br />The F lanning Commission shall not approve the subdivision of land if from adequate <br />investigations it determines that in the best interest of the public the site is not <br />suitable for platting and development purposes as proposed. <br /> <br />SECTION X - VARIANCES <br /> <br />A. Hardship <br /> <br />Where the subdivider shall show that a provision of the design standards or require- <br />ments of this ordinance, because of topographical or other conditions peculiar to the <br /> <br />- 18 - <br />
