A variance thus authorized is to be stated in writing in the minutes of <br />the Commission with the reasoning on which the departure was justified set forth. <br /> <br />B. <br /> <br />Group Housing Developments <br /> <br />A comprehensive group housing development, including the large scale construction <br />of housing units together with necessary drives and ways of access may be approved <br />by the Commission although the design of the project does not include standard <br />streets. lot and subdivision arrangements, if departure from the foregoing standards <br />can be made without destroying their intent. <br /> <br />SECTION Xl - FENALTIES <br /> <br />Any owner or proprietor of any tract of land who subdivides that tract of land and who <br />violate any of the provision of this ordinance shall be guilty of a misdemeanor, punish- <br />able by a fine of not less than ten dollars ($10) and not more than two hundred and fifty <br />dollars ($250), and each day after the first during which violation shall continue shall <br />constitute a separate violation. <br /> <br />SECTION XII - PROCEEDINGS TO PREVENT VIOLATION <br /> <br />Fursuant to Section 15-794.2, Code of Virginia, in case of any violation of the pro- <br />visions of this ordinance, or of any of the provisions of the regulations adopted as <br />authorized in this ordinance, the City Council, in addition to other remedies. may <br />institute any appropriate action or proceeding to prevent such violation or attempted <br />violation, to restrain, correct, or abate such violation or attempted violation, or to <br />prevent any act which would constitute such a violation. <br /> <br />SECTION XIII - APPROVAL OF FLAT PREREQUISITE TO RECORDATION <br /> <br />In accordance with Section 15-784, Code of Virginia, the Clerk of Court shall not accept <br />any plat for recording until such plat shall have been given final approval by the <br />Commission as provided in this ordinance. <br /> <br />SECTION XIV - AMENDMENTS <br /> <br />This ordinance may be amended in whole or in part by the Council provided that any <br />such amendment may either originate with or be submitted to the Planning Commission <br />for recommendation; and further provided that no such amendment sha.ll be adopted <br />without a public hearing having been held. of which at least two (2) weeks prior notice <br /> <br />- 19 - <br /> <br />i' <br /> <br />, <br />~( <br />.~ <br />'.'; <br />l''' <br />.~ <br /> <br />~~., <br />'" <br /> <br />~' <br /> <br />~;, . <br />~ <br />If, <br />. <br />w,: <br /> <br />~ <br /> <br /> <br />.~. <br />.~ <br /> <br />" <br />~ <br /> <br />, <br />~ <br />~ <br />t <br />~ <br />~ <br />; <br />1 <br />
